FIA to refer the 2024 USGP Lando Norris penalty to the ICA

The Issue

The FIA are obliged by their Code of Ethics to uphold the integrity of Formula 1 (F1). This includes ensuring that regulations are enforced correctly and that conflicts over the correct interpretation of the regulations are resolved.

F1 insiders and F1 fans are disputing whether the regulations were applied correctly by the stewards at the 2024 US Grand Prix on 20th April 2024. Lando Norris was ahead at the end of the staight by a cars length. Max Verstappen was ahead at the apex but was unable to get back past Lando without going off track and forcing Lando to also go off track.

McLaren F1 lodged a Right of Review and presented the decision dicument as the new evidence, insisting that it revealed that the stewards had applied the rules from the perspective of Lando overtaking on the outside, when Lando was in P3 before the end of the straight and Max in P4, therefore it was Max that was overtaking. The stewards rejected the new evidence on the basis that using the decision document as new evidence was unsustainable. McLaren have stated that the disagree with this interpretation. 

As long as Zak Brown disputes the decision, FIA have a responsibility under art 2.6 of their statutes to use their powers to resolve the dispute.

The decision to reject the new evidence cannot be appealed, but the original stewards decision still can. 

The FIA are able obliged to resolve the disputed interpretation of the regulation by referring the case to the International Court of Appeal (ICA) using their powers defined in article 9.1.1 of the FIA Judicial and Disciplinary (J&D) Rules. 

The ICA previously stated (in ICA-2023-03) that 'irrespective of all other circumstances' rules 'must be fully applied'. This includes the ISC rule that deliberately forcing a car off track is 'strictly prohibited'. A rule that ISC art 2.1.3.b forbids the F1 supplementary regulations from contradicting. The F1 guidelines attempt to amend 'strictly prohibited' to acceptable provided the car is ahead at the apex. This contradicts the ISC and therfore is 'of no effect'.

Lando and all the F1 drivers deserve better, more consistent decisions from the stewards that reflect the correct interpretation of the regulations as ratified by the trusted and qualified ICA judges.
