FIA to refer the 2021 F1 WDC to the ICA
The Issue
The FIA are obliged by their Code of Ethics to uphold the integrity of Formula 1 (F1). The potential regulation infringement(s) at the end of the 2021 Abu Dhabi Grand Prix has compromised this integrity.
In January '24 the International Court of Appeal (ICA) clarified the extent of the 'overriding authority' granted to Race Directors. They concluded that the Race Director must fully apply the regulations. This contradicts the conclusion reached by the Stewards at the post race protest. Had the regulations been fully applied (as required) the safety car would've stayed out 1 more lap meaning the race should've ended under safety car conditions with no overtaking allowed and thus Lewis Hamilton would've won the race and the 2021 World Drivers Championship (WDC).
F1 fans are now left in the position that it is unclear whether Max Verstappen really is the legitimate 2021 WDC. The interpretation of the regulations has never been ruled by ICA, who are uniquely qualified and trusted by FIA to decide the correct interpretation.
Contrary to the claim made in the report published in March '22, there is a mechanism to amend the classification. The FIA are able to refer the case to the ICA using their powers defined in article 9.1.1 of the FIA Judicial and Disciplinary (J&D) Rules. They are able to refer it to ICA until at least March '27 as there is a 5 year statute of limitation for regulation infringements. ICA have the authority to amend classifications under J&D article 10.10.2.
Alternatively, any FIA member can raise a complaint to the Ethics Committee that the Jan '24 ICA decision undermines the integrity of the 2021 WDC. They have until 28th Jan 2025 to do this, after which time only the Ethics Committee themselves are able to raise the complaint. The FIA president can 'decide to take any further action', including referring the matter to ICA.
