The Issue
Dear Friends and Advocates,
I am writing to bring attention to the undeniable challenges and unfair practices my fiancé and I have encountered during the K1 Visa application process, rooted in the refusal to trust the Philippine government-issued death certificate of my fiancé’s late husband. These issues underscore the need for systemic reform, as our journey has been marked by multiple 221(G) refusals, each demanding an exhaustive set of documents that extend beyond the realms of practicality.

Despite our best efforts, some requests are impractical, given the remote location on the Island of Caub, located the Philippines, where the tragic passing occurred. The lack of resources, financial constraints, and absence of medical facilities on the island have made it challenging to provide certain required documents. Along with trying to provide a government issued ID of someone that passed away in 2015.
Our pursuit of happiness and family unity, enshrined as fundamental rights or nation was built on, is hindered by a process that fails to recognize the unique challenges faced by families like ours. Furthermore, the lack of recourse for denials leaves us in a vulnerable position, as visa officers hold the authority to deny applications without providing justifications and denies us the chance to appeal to our judicial system designed to protect our rights.
I invite you to stand with us in signing this petition, urging policymakers to review and reform the K1 Visa application process. Let us advocate for a system that respects the rights of U.S. citizens, promotes transparency, and eliminates arbitrary decisions that impact the lives of families seeking to build a future together.
