Establish Neuro-Rights for the Citizens of the United States
The Issue
The "American Dream" began with freedom of thought.
As someone deeply concerned about the rapid advancement of neurotechnology, I believe it is high time we address this issue seriously. This technology, while promising in many ways, also opens up avenues for potential misuse and criminal activity. In a world where mind-reading isn't just science fiction but a very real possibility, our current laws are woefully inadequate to protect us.
Chile has recently taken an admirable step forward by introducing constitutional NeuroRights for its citizens - a first in the world. The United States, priding itself as "the land of the free," should not lag behind in ensuring similar protections for it's people.
According to research by Duke University (2019), brain-computer interfaces are becoming increasingly sophisticated and accessible. These devices can potentially be used to decode someone's thoughts or manipulate their brain activity without their consent - a clear violation of privacy and personal autonomy.
We need legislation that explicitly recognizes and protects our cognitive liberty, mental privacy, mental integrity, and psychological continuity – collectively known as NeuroRights.
Without these safeguards in place, we risk allowing unethical practices that could have severe implications on individual freedom and societal harmony.
While acknowledging that law enforcement has been using neurosciences such as "brain fingerprinting" techniques since at least the 90s, it's also very important to see this article by the FBI on "Law Enforcement Organizations: Possibilities and Challenges for the Future."
In the article we see the potential existence for these remote, reliable, and secret neuroimaging systems to be possible - as acknowledged by criminologist Jay Fortenbury on the FBI's Law Enforcement Bulletin (LEB).
The American people deserve more than just physical security; they deserve cognitive security too. It's time we call on our nation's leaders to acknowledge this emerging reality and take decisive action towards establishing comprehensive NeuroRights for all citizens.
