Enact protection laws for mental health patients

The Issue

Having been out of prison and away from the recidivism rate for 13 years, I built a life beyond my past felony. However, one day, I experienced a mental health crisis and was taken to a psychiatric ward. While in care, felony charges were brought against me by individual staff members for actions during my mental episode. This situation is not unique; it underscores a significant gap in our legal system that persecutes those already in vulnerable states.

The mental health system should be a sanctuary for healing, not another layer of the criminal justice system. Unfortunately, this is not always the case, and many individuals facing mental health crises find themselves re-entering the criminal system, facing charges for actions they cannot control while receiving necessary mental health care.

Statistics from the [Mental Health Foundation](https://www.mentalhealth.org show that 1 in 5 adults experiences mental illness each year, and the numbers are even higher among those who have faced incarceration before. The criminal records and prosecution add another layer of stigma and hinder individuals from seeking help, fearing the legal repercussions.

It is time to differentiate between criminal conduct and actions resulting from mental health crises. Individuals in the care of mental institutions or wards need protection, ensuring that they are treated as patients with medical needs rather than criminals to be prosecuted for their uncontrollable episodes.

I am calling on lawmakers to establish laws that protect mental health patients from being criminally prosecuted for actions during a crisis while under supervised care. Specifically, these laws should:

- Set clear limitations on the types of charges that can be laid against patients in mental health facilities.
- Ensure legal reviews are conducted with mental health professionals’ insights before charges are pursued.
- Create a balanced approach to addressing incidents in mental health settings where treatment and rehabilitation are prioritized over punishment.
