Empower homeowners! Amend Texas Property Code Chapter 209
The Issue
Picture this: There’s a hailstorm. Your roof is destroyed. You scrape together the money to cover the $5-$15k deductible to pay for a new roof. You forgot when you purchased the house 15 years prior that there is a document of rules and regulations (DCCRs) for the HOA where you live. And although you did the research to pick the best color roof for your home, you receive a violation notice from your HOA board/property management company telling you that the color you chose, although a reasonable and neutral color that increases the value of your home, does not meet the color requirement outlined in the community’s declaration of covenants, conditions, and restrictions (DCCRs). You are now required to rip off your brand new roof and replace it completely out-of-pocket. That’ll be another $20-$40k, please! Unbelievable, nightmare right? Well, this happened to us and dozens of other families in our neighborhood. The included image shows our roof before and after we were forced to change the color.
Due to Texas Property Code chapter 209, it is next to impossible to amend the DCCR‘s of an HOA. This leaves hard-working families powerless and burdened with enormous financial hardship when forced to comply with outdated and unreasonable regulations. We aim to put an end to this.
Texas law requires a 67% vote from the entire community to change an HOA’s governing documents. We can hardly get this voter turnout for our national presidential election. Despite our best efforts, we were unable to amend our governing documents to allow for more colors. Bound by stringent Texas law, our HOA board was required to force us to change our brand new roofs simply because they differed slightly in color from the regulations outlined in our (DCCRs).
By signing this petition, you are advocating for an amendment to Chapter 209 of the Texas Property Code. Specifically, we urge legislative stakeholders to revise the voting requirement from 67% of total HOA members to a simple majority of votes received. This change will enable us to prevent further undue financial hardships on homeowners, promote greater flexibility in community governance, and ensure that our voices are heard and respected.
