Allow Same Sex Couples the Right to Adopt Children

The Issue

On June 3, 2020, the Departmemt of Justice (DOJ) VOLUNTARILY filed a 35 page brief, under the disguise of having a vested interest in protecting the 1st Amendment’s Freedom of Religion, in Fulton v City of Philadelphia. 

According to this brief, the DOJ has urged the Supreme Court to allow adoption agencies to discriminate and reject LGBTQ+ families from adopting. More information on the court case at the bottom of the petition.

According to the preliminary AFCARS Report for Fiscal Year ending 2018:

-437,283 children were in foster care as of September 30, 2018, with 63,123 adopted with Public Child Welfare Agency involvement

According to ChildrensRights.org:

-In 2018, nearly 690,000 children spent time in U.S. foster care

-On average, children remain in state care for nearly 2 years. Staggering 6% of children in foster care have languished there for 5+ years

-Average age of kids entering care is 8

-In 2018, 1/3 of children entering U.S. foster care were young People of Color

-While most children in foster care live in family settings, a substantial minority, 10% live in institutions or group homes


According to AdoptUSKids.org:

-Each year, approximately 20,000 youth will age out of the foster care system when they turn 18 or 21, or when they finish high school (depending upon the state in which they live.) These children are at increased risk of poor educational outcomes, experiencing homelessness, and being unemployed.

 

The Washington Blaze summarizes the court case as follows:

The case came about after the City of Philadelphia learned in March 2018 that Catholic Social Services, which the city had hired to provide foster care services to children in child welfare, was refusing to license same-sex couples despite a contract prohibiting these agencies from engaging in anti-LGBTQ discrimination.

When the city said it would terminate the contract, Catholic Social Services sued on the basis it can maintain the contract and refuse placement into LGBTQ homes for religious reasons under the guarantee of free exercise of religion under the First Amendment.
