DOJ - Investigate the Texas Civil Commitment Office Under CRIPA
The Issue
We, the families of the men currently detained in the Texas Civil Commitment Center (TCCO), have been bearing the weight of injustice for years at the hands of this rogue state agency.
We live this struggle with heartache and persistence as TCCO continually and systematically violates the federally protected constitutional rights of these detained men and, indirectly, their families as well.
Our pleas for accountability and justice are met with indifference, as our attempts to reach out to the Governor's office have merely resulted in being redirected back to the very agency causing our distress.
There is an alarming absence of oversight and accountability regarding the operations of TCCO, a matter that requires urgent redress.
The board that the Governor believes is overseeing this agency is not only completely non responsive, they have gone as far as keeping the family from being allowed to comment at meetings.
Texas Health and Human Services, awards TCCO MILLIONS in tax payer dollars yet states they have no jurisdiction over this agency.
HHS pays the TCCO director Marsha McLane, a tax payer funded salary of $240,000 annually and she is writing and implementing state agency policy that is not in accordance with federal law or constitutional rights.
We are BEGGING the DOJ to hear our cries for help.
We, collectively, hundreds of men, and their families suffer daily at the hands of Marsha McLane, the Texas Civil Commitment Office, and the MTC employees following her policy that remains unchecked.
These men have been completely isolated from their family!
Family members - parents, children or spouses, are required to be interviewed, may be required to attend counseling at their own expense and waive their HIPAA rights so the agency may include themselves into these sessions.
Many men have no contacts to the outside world, and many have not been allowed to write, call, or have any 3rd party communication to their wives, children or parents because a TCCO employee decided so. This a violation of the right to familial contact under the 14th amendment of the United States constitution - this is only one of the MANY violations.
These men are forced to take polygraph tests, where they will be asked if they are communicating with their family. Upon failure of the polygraph they are placed into SMU (Isolation) as punishment.
Several men currently sit in isolation as we write this.
The phones are also currently down, while TCCO employees harass and conduct "investigations" to determine which men are attempting to contact their family.
The Department of Justice (DOJ) holds the power to conduct investigations under The Civil Rights of Institutionalized Persons Act (CRIPA), 42 U.S.C. § 1997a, to assess conditions and practices within institutions like TCCO.
With this petition, we wish to draw the DOJ's attention to the unsettling conditions at the Texas Civil Commitment Center. For years, the end to our suffering has eluded us. Now, we turn to the Department of Justice to hear our pleas and investigate the Texas Civil Commitment Office under CRIPA.
