The Issue
An Open Letter to All Landlords in Ontario
We, the undersigned rental housing providers across Ontario, are deeply concerned about the inefficiencies within the Landlord and Tenant Board (“LTB”) system, which undermine our ability to uphold our rights as guaranteed by the Canadian Charter of Rights and Freedoms. These delays have resulted in significant financial losses for us, estimated at about $1 billion annually, directly impacting tax revenues at all levels of government.
Petition Demands
We demand that the Government of Ontario take immediate action to address this issue by:
Implementing Automatic Eviction Orders: Rental housing providers applying to the LTB for eviction due to non-payment of rent should receive automatic orders without the need for a hearing, provided satisfactory proof of non-payment is provided.
Ensuring Timely Rent Payment: Tenants must be held accountable for paying rent on time, with no excuses permitted for non-payment. Disputes of another nature should be addressed through separate applications.
Limiting Delays: Tenants should not have the right to delay eviction proceedings except for proven compassionate or medical reasons.
Empowering Bailiffs: Private bailiffs should have the authority to execute evictions, similar to sheriffs.
Eliminating Delays: The standard 11-day delay implemented by the sheriff’s department should be eliminated immediately.
Preventing Last-Minute Payments: Tenants should not have the right to avoid eviction by paying arrears and legal costs at the time of eviction.
Impact Assessment
Such measures would significantly reduce the backlog of LTB cases, possibly by up to 50%, and put an end to extortion schemes that exploit delays in the system.
Addressing Financial Losses
Financial losses amounting to approximately $1 billion annually can be attributed to the delays at the LTB, impacting not only rental housing providers but also federal, provincial, and municipal tax revenues.
Recommendations for Immediate Action
We recommend the following procedure to be implemented without delay:
Housing providers should complete and file an online L1 application for eviction due to non-payment of rent, providing necessary documentation and sworn statements.
Tenants should be promptly notified of the eviction application and given two weeks to provide proof of payment.
Failure to provide proof within the specified timeframe should result in automatic eviction orders.
Constitutional Rights
Section 11(b) of the Canadian Charter of Rights and Freedoms ensures the right to a fair and speedy trial. Timely resolution of disputes is crucial for upholding the rule of law and maintaining public confidence in the justice system.
