The Issue

In the United States, systematic inequalities in the juvenile justice system disproportionately impacts youth of color, those from low income communities, and other marginalized groups. Racial and socioeconomic disparities in sentencing and access to diversion programs perpetuates cycles of incarceration, instead of offering second chances and support for rehabilitation. 

We believe that all children deserve an equal opportunity to grow, learn and succeed no matter their race, ethnicity, or economic background. Evidence shows that diversion programs-such as counseling, mentoring, and community service- are effective alternatives to incarceration, yet these programs are often inaccessible to underrepresented groups. The Public Sector Equality Duty mandates public authorities, including the government and police, to consider the impact of policies on people with protected characteristics, aiming to eliminate unlawful discrimination, promote equality of opportunity, and promote good.

The criminal justice system must ensure equal opportunities for all individuals, regardless of age, race, sex, religion, or protected characteristic, but some groups face poorer outcomes than their peers, according to numerous reviews.

We can work to eliminate systemic bias by holding policymakers accountable, advocating for co-design of policies and services with minority groups, and promoting greater racial diversity in the criminal justice workforce. They also encourage more inclusive practices from sector employers.

By implementing diversity, equity and inclusion (DEI) strategies, we can create an inclusive society that recognizes the potential and value of every individual, regardless of their past. 

Raising awareness about youth justice system challenges misconceptions and stereotypes, shifting narrative from fear and judgment to compassion and support through education and dialogue.
Fair access to education, employment, and housing is crucial in reducing barriers to reintegration into society and challenging negative stereotypes and prejudices.
We call on The Colorado Juvenile Justice and Delinquency Prevention (JJDP) and Colorado state legislatures to take immediate action to address these disparities and ensure equity in the juvenile justice system by: 

Conducting regular equity audits Assessing sentencing and diversion programs enrollments rates to identify racial, ethnic and economic disparities. 
- Providing resources to underserved communities
Increased funding for diversion programs in historically underfunded areas to expand their reach and impact.
- Implementing Anti-Bias training for Decision-Makers
Require judges, probation officers, and law enforcement to undergo training on implicit bias and equitable sentencing practices.
