A Bill to Protect Worshipers and Maintain Public Order near Places of Worship


A Local Law to amend the administrative code of the city of New York, in relation to prohibiting intentional harassment and disruption within a specified distance of a house of worship during services.


§1. Purpose and Intent
The New York City Council finds that protecting the free exercise of religion is a fundamental right. It is a matter of public concern to ensure that individuals can access and exit places of worship without experiencing intentional and unreasonable disruption or harassment during services. This law seeks to balance the constitutional rights of free speech and assembly with the right of congregants to practice their faith peacefully, without fear or intimidation.
§2. Definitions
"House of Worship": Any church, synagogue, mosque, temple, or other building, structure, or place used for religious worship.
"Worship Services": Any organized religious service, ceremony, or activity conducted by a house of worship, including but not limited to regular sermons, prayer meetings, and special events like weddings or funerals.
"Intentional and Unreasonable Disturbance": Engaging in conduct with the purpose of disturbing, interrupting, or disquieting a house of worship. This includes, but is not limited to, loud noise, profane discourse, or intimidating behavior that disrupts the solemnity of worship services.
"Buffer Zone": A designated area extending 100 feet from any regularly used entrance of a house of worship during the scheduled times of worship services.
§3. Prohibited Acts within the Buffer Zone
It shall be unlawful for any person to engage in an intentional and unreasonable disturbance within the buffer zone during scheduled worship services.
§4. Enforcement and Penalties
Notice: Law enforcement officials may provide oral or written notice to individuals causing an intentional and unreasonable disturbance in the buffer zone to cease such activity.
Violation: Any person who, after receiving a warning, continues to intentionally and unreasonably disturb worship services within the buffer zone may be found in violation of this law.
Penalty: Violations shall be punishable by a civil penalty not exceeding $500 for a first offense. A second or subsequent offense may result in a higher civil penalty.
§5. Constitutional Considerations and Severability
Narrowly Tailored: This law is narrowly tailored to address the specific problem of intentional and unreasonable disruption of worship services and does not prohibit all forms of protest or speech.
Content Neutrality: This law is content-neutral, meaning it applies to all persons regardless of their message. It is a time, place, and manner restriction, which is permissible under the First Amendment.
No Absolute Ban: Peaceful and non-disruptive protest activity is not prohibited by this law. It only targets conduct that is intentionally and unreasonably disruptive to worship services.
Separation of Powers: If any provision of this law is found to be unconstitutional by a court of law, the remaining provisions shall remain in full force and effect.
§6. Effective Date
This act shall take effect 180 days after it becomes law.
