Dear Governor Mr.Phil Murphy,
I am writing this letter to express my unwavering support for the clemency petition of Sharif Torres, who has been wrongfully convicted of murder in the State of New Jersey. After careful review of the facts, evidence, and judicial processes surrounding Mr. Torres’ case, it is evident that his conviction resulted from a miscarriage of justice, and I respectfully urge you to grant him clemency.
Sharif Torres’ conviction was based on flawed legal proceedings, questionable evidence, and a lack of due process protections. Under both state and federal law, every individual is entitled to a fair trial, the presumption of innocence, and due process as guaranteed by the Sixth and Fourteenth Amendments of the U.S. Constitution. However, in Mr. Torres’ case, these fundamental rights were compromised. Issues such as prosecutorial misconduct, ineffective assistance of counsel, unreliable witness testimony, and/or improper forensic procedures have contributed to an unjust outcome.
The New Jersey Criminal Code and relevant case law emphasize the importance of justice, not merely convictions. Under N.J.S.A. 2C:44-1, mitigating circumstances must be considered, including wrongful convictions and new evidence that casts doubt on a defendant’s guilt. Furthermore, precedent set by State v. Nash, 212 N.J. 518 (2013) underscores the judiciary’s obligation to rectify wrongful convictions when credible evidence arises. Clemency is not only a legal remedy but a moral imperative when justice has clearly failed.
Governor, as you know, executive clemency exists to correct legal wrongs when the justice system fails to uphold fairness. As granted by Article V, Section 2 of the New Jersey Constitution, you have the authority to review and correct wrongful convictions through clemency. Mr. Torres’ case is one that deserves such consideration.
Beyond the legal and procedural failures in his case, Mr. Torres has demonstrated resilience, remorse for any past mistakes unrelated to this conviction, and a commitment to rehabilitation despite his unjust incarceration. His wrongful imprisonment has caused immense suffering not only for him but for his family, friends, and community—many of whom stand in solidarity with this request for clemency.
