CBI investigation for the suspicious death of Niloy Sengupta, whose body was found 6-Sep

The Issue

Silence most brutal and inaction most agonizing. This is what was served to me, the kin of a talented young learner of music who allegedly went missing on 4th September 2016, and whose body was found on 6th September.

Niloy was part of the group that went to a party organized at Blue Bay resort at Mahabalipuram, TN along with other 41/42 students and 7 no of professors/faculties of Swarnabhumi Music Academy in Chennai. We received a call from the college administration late 11:40 at night on 4th Sep informing me of my child being missing since 4th September 6.30 pm IST. On hearing this, myself and my elder son immediately flew to Mahabalipuram, to look for him. Prior to that, I had contacted some friends locally to assist, who arrived at the college premises 2:30 am on 5th Sep.  On arrival, initial enquiries to trace my son brought forward varied responses some contradictory.

However, no account did the college administration allow the friends who had arrived earlier or even myself,” father to the missing child”, to enter the premises of the college or interact with any of the faculty or the students who had been a part of the group at the resort to gather any possible information in locating my missing son.

Any information could have been vital to finding Niloy, but we were deprived of all possible support by the college administration in locating the missing child. A child that went missing under their care and watch. Therefore any attempt to find his missing son was thwarted right at the roots by the college administration, equally appalling was the inaction by the police initially who was contacted when the boy went missing and a complaint was lodged. I being the father of the missing boy have not been allowed to have a look at the CCTV footage from the resort where he was last seen. 

I received a call from the police station on 6th September to inform that they found the missing body of Niloy despite the fact that the initial complaint was made by the college authorities.

 Now the facts as below:

1.     The FIR was registered on 5th September i.e one day later at 11.00 hrs after 15.5 hrs of missing incidence. It was clearly mentioned in the FB page of S.A.M. (Swarnabhoomi Academy of Music), that, Police refused to register the FIR before 12 hrs of the missing. Moreover Coast guard was also refused to help as official complain not registered.

          Isn’t the negligence of the officials? Includes, College management, Police, Coastguard and Resort Management.

 2.     The body was found within 100 m of the said resort, meaning he could have been found much earlier had the police was informed or react in time. Maybe Niloy would still be alive among us, had the college authorities & administration of Tamil Nadu cooperated and performed their duties responsibly. His human remains were found under suspicious conditions at a location that was previously searched by friends as well as college authorities.

 3.     He had multiple injuries on his head and neck indicating recent physical trauma (fresh blood) and signs indicating burn injuries on his left thigh and shoulder etc. when his body was found. (For your ready reference enclosing some photograph of the same)

 4.     The discoloration of his body is not uniform; the part of his body upward from his torso shows signs of discoloration, whereas the part below his torso seems intact.

 5.     The left thigh has markings; skin injury looks like it was caused by “fresh burning”.

 6.     From what has been seen of the college’s administration and their effort / attitude/ intention in finding my son while he went missing where the incidence occur or helping us by providing and gathering information after his body was found. 

 7.     There appears to be indications of foul play leading to Niloy’s death. He was last seen in a yellow T-shirt and shorts, however he had none of it on him when his body was found along with his rings which were in his hand.

 

Moreover as per the Post-mortem report, it is very surprisingly observed that,

1.     Niloy Sengupta died after 14 hrs & before 24 hrs of his missing. Sir, you will agree that, it is not possible for a non swimmer to survive in the sea wave current for such a long time.

2.     His stomach contains only 150 ml of watery fluids only with no smell. Thus means he was in empty stomach for not less than 8-12 hours before he died.

It is clear that, Niloy Sengupta was not died due to drowned, though it was placed like that.

No words spoken or written can ever console a grieving parent like myself, nothing will bring Niloy back. Having said that, I humbly request your support and assistance in obtaining justice for Niloy, a boy who came to Chennai to learn music for his love for music and returned in a coffin. For your ready reference I am enclosing the FIR copy registered at the E1 Mammallapurm Police Station TN 7 {register no- 327/2016, sec: Man missing @ 174 crpc (suspicious death)}.

It is clear that the investigation by the TN police cannot be neutral, because they have not taken any initiative even after the message conveyed by Commissioner Secretary of Home & Political, Govt of Assam to, Mr J. Tripathy ADGP (Law & Order) on Monday at about 2 pm.

Looking Forward your kind consideration in this matter and issue an order to investigate the case through an independent agency i.e. CBI.
