Re: SCBA letter dated 04-03-2022 to the Hon’ble Chief Justice of India on the subject above.

Sir,

This representation is being sent on behalf of members of SCBA who are taken by surprise by the SCBA’s stand vide letter dated 04-03-2022 addressed to your Lordship.

The subject matter of the said letter was in effect the issue for which a GBM of SCBA (Minutes of Meeting dated 18.02.2022 of the Election Committee for the Chamber Allotment {copy enclosed as Annexure 1}) was called.

AOR Association has sent a letter dated 5th March 2022 {copy enclosed as Annexure 2} objecting to the aforesaid letter of the SCBA as it was also not consulted. In this regard a letter dated 5th March 2022 {copy enclosed as Annexure 3} of the Ld. Attorney General has been received by SCAORA clearly stating that presence of SCAORA is necessary in the meetings of the committee.

It is submitted that there were only two proposals till date about the Allotment of chambers in the newly constructed Block-D of the Additional Building, Supreme Court Complex, which are as following: -

(i) Total number of 236 chambers were to be proposed to be allotted on twin sharing basis for which proposal for the Allotment of chambers in the Additional Building Complex of Supreme Court to the Advocates as per the roster, out of the then existing panels for the years 1995, 2001 & 2004 Scheme dated 05 July 2019 {copy enclosed as Annexure 4}, was also announced.

(ii) vide circular dated 16/02/2021 {copy enclosed as Annexure 5} of the SCBA the members were informed about the decision meeting dated 13.02.2021 of the chamber committee consisting Hon’ble Mr. Justice R.F. Nariman, Hon’ble Mr. Justice U.U. Lalit and Hon’ble Mr. Justice L. Nageswara Rao about the creation of 476 chambers for single allotment for the members that would be completed within 11 months of time. In this respect letter dated 02.11.2020 of the President and Vice President, SCBA is also very relevant (Copy enclosed as Annexure-6).

It is submitted that in both the aforesaid scheme more than 470 members were being accommodated in the new complex. Apart from the aforesaid two schemes for allotment of said chambers no other scheme were ever announced.

Therefore, it is kindly requested that the allotment may be done only on the basis of any of the aforesaid two existing schemes only, as large number of members of the bar are waiting for allotment of chambers, most of them having practice in the Supreme Court for more than 20 to 30 years, due to the succession rule and other issues many members don’t get a Chamber in their entire lifetime.
