Unscrupulous car dealers like CarMax, who profit from selling dangerous recalled used cars with killer safety defects, won big in New York recently -- putting used car buyers and their families, and others who share the roads, at risk of death or serious injuries.
New York's Attorney General approved settlements with 104 car dealers that allow them to sell unsafe recalled used cars without repairing the safety defects, if they merely disclose that they are under a safety recall. These are precisely the reckless, illegal practices that have gotten CarMax and other car dealers into trouble all over the nation.
Why are dealers like CarMax so eager to be able to get away with selling recalled used cars? Because it takes time to get the FREE repairs. That slows down how fast they can rake in profits and reduces the numbers of used cars they can sell. Plus currently, there are about 42 million recalled cars on the roads with unrepaired Takata airbags that can explode and spew shrapnel into the drivers' and passengers face, neck, and chest, causing blindness or other severe injuries, and sometimes causing them to bleed to death.
But -- there aren't enough replacement air bags available. It may take months before the cars can be repaired so that they are safe. Bottom line: the dealers don't want to wait until they can be repaired, so they are safe to drive.
New York has strong consumer protection laws, including a law that requires all car dealers to certify that each car they offer for sale is "roadworthy." Plus New York has a used car lemon law that gives added protection. Julie Menin, Director of New York City's Department of Consumer Affairs, enforced those laws by cracking down on car dealers and prohibiting them from selling unrepaired recalled used cars. To her credit, she placed the safety of New Yorkers above dealer profits.
Tragically, New York Attorney General Eric Schneiderman failed to follow Julie Menin's pro-consumer, pro-safety example. Instead, he opened the floodgates for New York to become a dumping ground for cars with lethal safety defects. No other state allows such dangerous practices.
While usually Mr. Schneiderman is pro-consumer, in this instance, he really blew it.
