Monica is an 8-year-old Autistic child that lives with her father in the state of Texas. Recently, her biological mother has decided to petition for enforcement of pervious custody arrangement of her daughter without considering the effects it could have on her daughter. Additionally, she will be moving Monica into a potentially dangerous situation, because her mother currently resides with an individual whom is currently facing criminal charges and not allowed to be near minors unsupervised. The mother lives in the state of Wisconsin and asked the Forest County circuit Courts to honor the previous custody agreement, ignoring the danger that awaits her in Wisconsin. Some would say this is a standard procedure and to let the courts take care of the dispute; however, this case shows a total breakdown of our judicial system for both Monica and Her father. They are not being given proper legal representation or the appropriate accommodations for their side to be heard. The intent of this petition is not only to show support for Monica, but also to give her a voice one that can be heard around the community.

This case contains multiple factors that led up to this advocations and call for support:

1.     Monica’s Father has been denied any advocate or legal representation by Forest county courts for not being able to articulate his arguments and properly fill out his forms. The court refused to allow the father the use of his advocate or attorney from his local district. Furthermore, when the father asked for time to gain legal representation, he was not only denied that opportunity, but also held in contempt and ordered to attend mediation session.

2.     The Forest County Circuit court also have not provided Monica with her own legal representation or Guardian ad litem. Monica not only has no say in the manner, but she also has no advocate to speak on her behalf about what is best for the minor. Her father and stepmother are trying their best to help her through this confusing and difficult time with little to no help from the courts. The advocate that they do have is not licensed as a lawyer in the state of Wisconsin and therefore was denied the ability to speak on Monica or the family’s behalf.

3.     The case was filed in the state of Wisconsin however, Monica lives in the state of Texas. The courts have threatened to have the father violated for a court order if he did not purchase a ticket for the minor to be returned to the state of Wisconsin.

4.     To complicate the matter further Monica’s Mother makes this request for custody while living at the same residence of man who is currently under house arrest and facing criminal charges. These charges currently include two count of Possession of Child Pornography. Additionally, part of the man’s bond agreement requires him to have no unsupervised contact with minors. Part of the argument made by the mother, is the fact that she has other children residing with both her and this suspect/criminal.

 

Monica has no representation, no advocate, and no voice in this case. The Forest County courts do not seem to care and have decided to do whatever they like, even if it means placing a vulnerable child into a potentially dangerous situation with total disregard for her safety. If the courts will not allow Monica to have a voice, then we the people will be her voice. We need to be many, we need to be loud, we need to protect our youth, and we need to be Monica’s voice. We ask you now to please sign the petition and let Monica be heard, let’s protect this innocent child from corruption and manipulation.
