The Issue

CVS/Caremark, who provides mail order prescriptions for my Part D Medicare Plan (HealthNet Orange Option 1) has deliberately failed to acknowledge a dangerous prescription error, and to add insult to injury, "claimed in writing" to refuse to send the medication to me via overnight mail, though it did arrive via overnight mail today. Going without this medication can be life-threatening. CVS/CAREMARK IS SO AFRAID OF BEING SUED, THOUGH THEY CLEARLY DESERVE IT, THAT THEY REFUSE TO ADMIT THEIR ERROR IN WRITING, THINKING THAT BY SENDING IT OVERNIGHT MAIL, WITHOUT ADMITTING WRONGDOING, WILL MAKE IT RIGHT, OR PREVENT IT FROM HAPPENING AGAIN.

On March 12, 2010, my endocrinologist electronically submitted to CVS/Caremark a prescription for brand-name Synthroid, clearly indicating MEDICALLY NECESSARY, as required by law. Rather than fill the prescription, CVS/Caremark automatically ASSumed it was another prescription for the generic, neglectfully overlooking the MEDICALLY NECESSARY notation and the fact that the provider clearly no longer wants me to take the generic. Going without thyroid medication can cause death.

I sent several online secure messages through the CVS/Caremark login website, and when they responded--if they even bothered to respond at all--they repeatedly spit back the same response--claiming they couldn't fill the prescription until April 3, 2010, because a prescription for the generic had recently been filled, and though I repeatedly sent CVS/Caremark messages that it was not the same prescription, that the physician did not want me to take the generic any longer, and that they should contact the physician's office for verification. They continued to refuse to fill the prescription or contact the physician's office for verification, so I sent e-mails to all the CVS/Caremark employees listed below, after which they claimed they sent it out on 03/29/10 via regular delivery, though by actually sending it overnight mail is clearly an admission of error on their part of deliberately and carelessly endangering my health, for which CVS/Caremark has deliberately created a legal liability for themselves.

I also filed a Complaint with the FL Dept of Health (MQA_Pharmacy@doh.state.fl.us) and with as many agencies and pharmaceutical organizations as possible, in addition to posting this Petition/Boycott on the Internet to BOYCOTT CVS & Caremark until they acknowledge the error and are held accountable by CMS, and the FL Dept of Health.
