My daughter was given fentanyl, an illegal substance that took her life on April 12, 2020.  This is ultimately why I have chosen to really study the laws in Missouri regarding drug induced homicide.  The unfortunate thing is, there is not a law written in black and white to address this issue. A lot of times these cases are not fully investigated, instead written as a drug overdose and closed.  This can not continue as is.  There are kids dying that are poisoned, they have no idea they are ingesting fentanyl.  They are lead to believe are taking something that is not deadly.  These kids are experimenting and not given the opportunity to learn, they are dying. We need a law in place to help protect our kids.  The laws as written do not protect these children without having to find loop holes.  We have a second degree murder charge that states if a person commits or attempts to commit any felony and a person is killed during the felony or flight from a felony they are guilty of second degree murder also know as felony murder.  We are seeing more cases being brought on this charge but many plea down and get very little time if any.  We need a clearly written law such as in our bordering state of Illinois, their drug induced homicide law that recognizes this offense as a criminal killing.  This is described as unlawfully delivering a controlled substance to another, and any persons death is caused by the injection, inhalation, absorption of any amount of that controlled substance.  A clearly written law giving law enforcement the necessary approval to fully investigate and prosecutors the ability to prosecute these cases as homicide. Statistics show that death due to overdose, which in my personal opinion should be called poison, are on the rise and continuing to take young kids and adults in alarming numbers. The stigma held with these deaths has got to change and we must change our mindset and help be the change for these kids that no longer have a voice.  You may think it was their choice to take whatever they were given.  They were given an illegal substance without the mention of this can kill you, should that be common knowledge when dealing with drugs?  In a perfect world yes it should be but we are talking about immature minds and mental illness.  These lives matter and if we can get a bill introduced to help protect these kids and young adults, we will save lives.
