Bill Proposal for the Urgent Need for Safety Fencing Around Retention Ponds

The Issue

As a concerned resident of Liberty Township, OH, I am calling on the State of Ohio to implement a policy requiring safety fencing around all accessible retention ponds and similar man-made bodies of water. This is a critical issue that directly affects the safety of our children, especially those with autism spectrum disorder (ASD) and other developmental disabilities.

Children with autism are often drawn to water and may not recognize the dangers it presents. Their unique sensory and communication challenges can make them especially vulnerable. Tragically, drowning is the leading cause of death for children with autism, a heartbreaking and preventable reality.

Retention ponds, while essential for stormwater management, are often unfenced and easily accessible, with steep, unstable banks that can be deadly to an unaccompanied child. Unlike swimming pools, which are usually protected by safety barriers, these ponds remain dangerously exposed in residential and public areas.

We believe it’s time for Ohio to act. Installing safety fencing around retention ponds is a simple, proactive measure that can save lives. Other states and municipalities have taken similar action for swimming pools, Ohio can and should do the same for retention ponds.

Yes, this will require planning and investment. But the cost of prevention is far less than the unimaginable cost of a child's life lost to a preventable tragedy. Let’s take a stand together to protect our most vulnerable community members and bring greater peace of mind to families across the state.
