The Issue
Families Deserve Justice — Demand Proper Compensation for Systemic Failures
Across the country, families are being let down by councils and schools that fail to meet their legal duties. Children with special educational needs, including my own, are left without education, parents are forced to fight for basic support, and vital services are delayed, denied, or delivered unlawfully. These failures cause real harm: lost learning, emotional distress, financial stress, including loss of jobs and in worst cases homes, and long‑term damage to children’s futures.
Yet when families seek redress, compensation is often inadequate, inconsistent, or entirely absent. Councils routinely minimise fault, delay investigations, or offer token payments that do not reflect the seriousness of the impact. This leaves families carrying the burden of failures they did not create.
This must change.
We call on the UK Government, Local Authorities, and oversight bodies to:
1. Introduce a national standard for compensation in SEND and education failures
Families should not face a postcode lottery. Compensation should reflect the actual harm, including missed education, emotional distress, financial losses, and long‑term impact.
2. Require councils to provide automatic compensation for prolonged missed education
When a child is left without suitable education for weeks or months, families should not have to fight for recognition. Compensation should be mandatory, not discretionary.
3. Strengthen accountability for councils and schools that repeatedly breach statutory duties
Chronic failure should trigger enhanced financial remedies, independent review, and mandatory improvement plans.
4. Ensure Ombudsman remedies reflect real‑world impact
The Local Government & Social Care Ombudsman should adopt higher minimum payments for missed education, unlawful delays, and failure to provide SEND provision — recognising the seriousness of these faults.
5. Provide reimbursement for professional reports and private provision families are forced to obtain
When councils fail to assess, support, or provide therapy, families should not be left out of pocket for essential reports or interventions.
