Being recorded at a gym should be illegal!!! Guess what it's not!!!

The Issue

I experienced first hand being video recorded. For the entire duration of my workout, I had someone follow my every move with a hidden camera. To find out later, it was sold, and I had no legal recourse. I felt completely violated! Sadly, because it wasn't in the locker room, or restroom, legally there was no recourse. I was advised there was nothing I could do, no legal avenue to pursue. It was ok??? You see, according to privacy laws in the U.S. the gym is considered a public place. Even with gym rules stating: no cameras, no pictures or video of any kind, it doesn't matter, or hold up with the current privacy laws. No Privacy in Public Places Since most gyms are accessible to the public. It legally is not a violation of privacy laws to record someone in a gym's common area. Typically the law does not prohibit viewing or photographing activities which are outside a person's reasonable expectation of privacy. As long as the subject is a clothed gymgoer in a common public area, the law provides little, or no protection. There are countless stories online of similar situations. I think an exception needs to be added to the privacy laws. Outlining that a reasonable person would not want to be recorded or photographed while working out and exercising. What do you think?
