The Premier David Crisafulli & the Housing Minister Sam O'Connor continually announce how the CMFEU is corrupt, a bully & they have removed the BPIC. But the BPIC is not for residential buildings & the QBCC is no better than the CMFEU when it comes to manipulating the legislation & replace it with their interpretation under common law.
MONOPOLY lets everyone have a chance of owning property, building a house & enjoying life..... But not when it comes to the QBCC Home Warranty Insurance (HWI) Scheme & the failing system that is meant to protect homeowners, but instead enables builders to walk away with your money & the QBCC having double jeopardy on your claims. Either way homeowners loose & are left to clean up the mess.
Homeowners ask yourself these questions:
- The QBCC advise they don't get involved in contractual matters; yet they make decisions on your HWI claims under the contract;
- How many lawyers do you think the QBCC has on the payroll?;
- How many engineers or certifiers are employed by the QBCC?
- When the QBCC need a engineer or certifier are they sending their own staff or contracted a business to assess the issue(s) of building works and who is paying them for that report?
- Why won't the QBCC be transparent and provide an unredacted copy of that report; but you have to provide yours; & why does
- The builder refuses to answer appropriate questions & then it should be classified as an admission of guilt; not innocence? e.g. Under the Corporation Act 2001 are you financially viable to still trade?
- Who are making the technical decisions on your claims; if it's a so called licenced builder (or office person); remember a QBCC Licenced Builder is why you are in this situation to start with?
- Why do you think the QBCC refer to works as incomplete & not defective works?
The QBCC use at different stages of the contract in conjunction with your HWI claim process collectively to 'get out of jail' in NOT paying the HWI Claim.
As a regulating entity; do the QBCC report breaches or offences to the required entities for investigation for wrong doing; even under their own legislation. The QBCC require a person or company to do that for them when the builder or the QBCC fail to regulate and protect the homeowner, trades & subcontractor's?
BEWARE HOMEOWNERS: If the builder puts in that the homeowner needs to get the building approval, it then places you at even more risk & DO NOT DO IT! Remember the builder is responsible to adhere to:
- Building Act,
- Planning Act,
- WPH&S Act,
- QBCC Legislation,
- Corporate Act,
- Australian Investment Securities Commission,
- Board of Engineers Qld, and the list goes on......
COMMON LAW DOES NOT OVERRIDE LEGISLATION!
