Bail conditions for violent crimes
The issue
On Saturday, the 24th of June, a 000 call resulted in police & paramedics attending a unit in Ayr, Qld.
My little brother was bashed into a coma.
He had been dealt a massive head injury, was unresponsive and subsequently flown to Townsville Hospital in a critical condition where he was placed on life support.
Thanks to the tireless work over the weekend of the Detectives from Townsville CIB, the unit was turned into a crime scene and they discovered that my brother had gotten into a heavy altercation with his so-called "best mate" who had left him there in a critical condition, fleeing the scene. The police worked relentlessly until he was found & took him into custody on Sunday. He refused to interview.
Unfortunately, when this vile excuse for a human fronted up to Ayr Magistrate's Court, the Magistrate decided to grant him bail - DESPITE the Detectives strongly opposing bail due to the nature of my brothers injuries, the crime scene and the aggravated assault he inflicted upon another.
Conditions were set for his bail but they were a drop in the ocean compared to the fact that he gets to go and live his daily life while my brother clings to his in the ICU.
Violent criminals who have hurt someone, who have done damage to another humans life to even require hospital treatment, let alone into a coma, let alone into the ICU, should NOT be allowed to simply go home and eat dinner with their family!
It's day 12 today, 5 July 2023! My brother still lays, post-coma unresponsive on a life support machine in the ICU. His head injury is traumatic, life changing.
Our lives are all hanging in the balance while we wait to see if he even wakes.
Then....we will wait to see if he becomes aware, then more waiting to see how much brain damage has been inflicted, then it's a massive rehabilitation program and recovery period.
If he even gets those chances at life now....
The waiting is horrendous. The most horrible hanging-in-the-dark I've ever experienced while his violent attacker gets to freely wander around, go out for lunch, spends time with his family, goes shopping and does all the normal things despite the damage he has inflicted upon another......
I'm calling for the Bail Act 1980 (Qld) to be changed for ALL Assault charges as defined in section 245 of the Criminal Code!
Bail must NOT BE granted for violent assault, serious assault, aggravated assault and/or assault occassioning bodily harm.
No conditions.
No bail.
If someone commits a violent crime, they belong straight in jail to be remanded in custody until their scheduled court appearance. It's the only way to help keep someone else's loved ones safe.
Please help me keep violent attackers off the streets!
