Amend the US Constitution, limiting the pardon power of the President of the United States
The Issue
On July 1st, 2024, the Supreme Court of the United States ruled that a President of the United States had absolute immunity in exercising their power to pardon and that this power was not reviewable by the Congress, nor the courts.
This opinion, now opens up our Republic to the threat of tyranny and despotism if the President chooses to order the assassination of their political rivals and then pardons those who carry out the assassinations.
In order to prevent this from occurring, we believe that a Constitutional Amendment, moving the power to pardon from the preclusive and conclusive power in Article II, Section 2, Paragraph 1, to the following paragraph, thus requiring a two-thirds majority vote in the Senate, would greatly diminish any temptation for a President who sees themselves as a would-be monarch.
The uncheckable power of the pardon is a vestige of 18th century monarchy, and has no place in the hands of one person.
