The issue

Growing up, my sister and I faced unimaginable challenges that stemmed from being victims of serious child sexual offences within our family. Our experiences are not isolated. Incidents like ours happen far too often, leaving scars that last a lifetime. This is why the Bail Act 1977 (Victoria) must be urgently amended to bolster the protection of children and prioritize their safety over the rights of offenders.

The current state of the Bail Act 1977 permits offenders charged with heinous child sexual offences to secure bail, often putting the victims and other potential victims at risk. According to Victoria Police statistics, there has been a concerning increase in crimes of this nature, highlighting significant gaps in the existing legal framework that pertain to the granting of bail. Children, particularly vulnerable to further harm, need stronger safeguards that prioritize their protection above all else.

We propose a crucial amendment to the Bail Act 1977 that would establish a stronger presumption against granting bail to individuals charged with serious child sexual crimes. A revision of this nature would reflect a commitment to a safer community and the acknowledgment that the rights of innocent children deserve the highest protection.
