Amend Colorado Laws to Recognize Pets as More Than Just “Property”
The Issue
Speaking as a lifelong Colorado resident and dog lover, I have personally experienced the shortcomings of our current legal framework where dogs are unjustly considered mere property. Our laws fail to consider the best interests of the dog when deciding custody during disputes or separations. Tragically, these beloved canines are thrust into property disputes, referred to as a "replevin case", stripped of their true identity - they are not merely possessions or chattels, but family. Unconscionably, our system treats them no differently than an inanimate piece of furniture.
Colorado isn't alone in its approach - across the US, pets are generally regarded as property under state laws. However, times are changing and some states have begun enacting legislation that sees pets as more than just property, once again putting the needs and welfare of these animals at the forefront. Alaska and Illinois, for example, have pioneered legislation considering pets' well-being in custodial disputes.
In 2017, Alaska introduced legislation (Alaska HB 147) giving courts the power to consider the welfare of pets in divorce proceedings, blazing a trail for other states to follow. Similarly, Illinois passed a law in 2018 that allows judges to consider what's in the best interests of the pet in divorce situations. These progressive moves acknowledge the unique relationship between humans and their pets and set a precedent for the rest of the country.
It's clear there's momentum for change. Let's follow suit and amend Colorado's laws to recognize the special place dogs—and all pets—occupy in our homes and hearts. Let us replace the outdated notion of pets as property with a more compassionate perspective, focusing on their well-being and interests, just as we do for human loved ones.
