Aided school teachers recruitment through Kerala Public service commission

The Issue

To the Chief Minister of Kerala 

  Petition to be submitted by the candidates of Kerala State who have written the name and educational qualification below.

 

 Dear Sir,

 

 We have learned that the largest employment sector under the Government of Kerala is the Departments of Public Education and Higher Education.

 We have come to know that the six-judge Constitution Bench of the Supreme Court on 22-05-1958 while deciding the complaints regarding the Education Act of the First People's Government of Kerala stated that the power of appointment rests with the Government which bears the expenditure.

 It is also known that in 1960, section 11 of the Kerala Education Act was amended and the power of appointment was vested in the management.

 

 It has been learned that the Supreme Court is considering the case filed by the candidates against the non-grant of reservation as per UGC norms in the rules as per the agreement made by the Government of Kerala with the aided college managements in 1971.

 

 It is seen that Kerala is the state with the highest increase in the unemployment rate of academics. Recently, the media has reported the news that many of the appointments in aided educational institutions are made on the basis of unethical considerations. For example Mr. AK Balan who was the Minister of Scheduled Castes, Scheduled Tribes and Other Backward Classes Development Department and Law Department in your first cabinet said in Asianet News on 22 - 05 - 2022 that one of his relatives got appointed in an aided school by bribery.

 He has also made it clear that the LDF government that came to power is ready to leave appointments in aided educational institutions to the PSC.

 A report submitted in 2017 for the Youth Affairs Committee of the Kerala Legislative Assembly also recommended that appointments in aided educational institutions should be left to the PSC and reservations should be introduced.

 

 On 06-01-2020, in the West Bengal Madrassa case judgment, the Supreme Court has ruled that the authority to appoint teachers who teach subjects other than religious studies belongs to the government which bears the cost.

 

 The Khadar Committee appointed by the Kerala government has also recommended that appointments in aided educational institutions should be left to the PSC to improve public education.

 

 Therefore 

 The first people's government in Kerala 

 It is requested to restore the 11th section of the Kerala Education Act that the appointment will be made through PSC and cancel the agreement made by the government of Kerala with the aided college managements and introduce and pass the bills to make the appointment through the PSC in the assembly and protect the equal opportunity and reservation based on social justice guaranteed by the Constitution of India and thereby make the name of Kerala the second renaissance.

 

 In the last quarter of the 19th century for the fair rights of the Malayalis 

 Considering the historical importance of the Malayalee memorial dedicated to the Travancore ruler in 1891, we have decided to name this petition of the youth of Kerala as 'Second Malayalee Memorial' in the 21st year. Hoping to sympathetically consider this legitimate demand and take an appropriate decision,
