The Issue
Since late August, I, and many others in the community, have been inundated with violation notices from the Williamsburg Parish Homeowners Association (HOA). This sudden uptick is concerning. An HOA’s main role should be to support residents, foster community spirit, and maintain property values—not to create an atmosphere of intimidation through excessive or arbitrary enforcement actions. Stringent measures without clear communication or necessary justification cause unrest among community members, leading to a feeling of being policed in our own homes.
The Williamsburg Parish HOA was established to ensure the community is a safe, welcoming, and harmonious living environment for all residents. However, there appears to be a recent shift toward overly aggressive enforcement measures that are impacting the comfort and well-being of many community members. Some violations seem trivial and inconsistently applied, lacking transparency and fairness.
By signing this petition, you are urging the Williamsburg Parish HOA to reconsider its approach to CCR enforcement to ensure it is fair, transparent, and beneficial for all community members. Together, we can advocate for a balanced community where residents feel respected and heard.
One, of the many notices I personally received, was in regard to a tree in my front yard that allegedly required trimming. The tree in question was professionally trimmed three years ago at a cost of approximately $500. In my violation notice, the HOA cited the following language:
“Tree and Lawn Maintenance: Homeowners are responsible for keeping all grass, weeds, and landscaping—including trees—cut and maintained in a sanitary, healthful, and attractive manner (Section 6, CCRs, p. 9).”
After reviewing the CCRs, I could not locate this language, nor does it appear on page 9 of any of the 12 CCRs. When I sought clarification, I did not receive a response.
Over time, I was given multiple and conflicting explanations: that the tree encroached on a neighbor’s property, then that a branch overhung the sidewalk, then the road, and finally that the HOA applies county standards requiring trees to be 13.5 feet above the roadway. No measurements were taken to confirm whether my tree failed to meet this standard. I was also informed that inspections are conducted without exiting the vehicle.
Furthermore, none of these standards appear in the CCRs - which are the only standards the HOA has the power to legally enforce. The homeowner portal contains 12 separate CCR documents, yet the HOA declined to identify which specific CCRs applied to my property. After reviewing all of them, I could not find the language cited in the violation notice.
This petition is not about avoiding reasonable rules, it is about ensuring enforcement is clear, consistent, and grounded in the governing documents that homeowners are expected to follow.
