The Issue
If I’m going to complain about the country we live in, I can’t say that I didn’t try to do something about it.
This is a nonpartisan call to action for the people. This petition is meant to unify the public under a common goal to uphold our constitutional rights and ensure that no form of government hierarchy gains too much power and that that power is left to the people in which it was founded for.
The United States was and is founded upon the principles outlined in the U.S. Constitution; The United States is a nation that promises justice, liberty, and the protection of inalienable rights. However, over time, there have been numerous instances where actions and policies implemented by the federal government have undermined the very Constitution it is sworn to uphold. The failure to protect these fundamental rights and principles calls for a movement that seeks to demand accountability, restore constitutional governance, and ensure that the government is once again bound by the rule of law as established in the Constitution.
Objectives:
- To restore adherence to the U.S. Constitution by the government of the United States, ensuring the separation of powers, protection of civil liberties, and upholding of citizens’ rights.
- To demand accountability from elected officials and government agencies that have violated constitutional principles.
- To create a united front of citizens who collectively express their grievances and demand reforms through peaceful, lawful means.
- To establish a platform for public discourse that can mobilize citizens, call for action, and provide solutions for rectifying constitutional violations.
Rationale:
In the spirit of collective action, this proposal seeks to unify citizens across the country who believe that the government is failing to uphold the Constitution and thus is not serving the people’s best interests. This movement would be driven by a widespread understanding that the government’s failure to act in accordance with the Constitution directly impacts citizens’ rights, freedoms, and well-being.
Constitutional Violations:
1. Violation of First Amendment Rights:
- The government has increasingly enacted policies that suppress free speech, such as through government surveillance programs and laws that restrict the free press or the expression of dissenting opinions. For example, the Patriot Act of 2001 allowed for extensive surveillance without proper judicial oversight, infringing upon Americans’ rights to privacy and free speech.
2. Violation of Fourth Amendment Rights:
- The Fourth Amendment guarantees citizens the right to be free from unreasonable searches and seizures. However, numerous government actions, such as the NSA’s mass data collection efforts, have undermined this right. The Edward Snowden revelations exposed government practices of illegal surveillance on citizens without due process or sufficient justification.
3. Erosion of the Separation of Powers:
- The principle of the separation of powers, as enshrined in the Constitution, ensures that no one branch of government holds too much power. However, there have been instances where this balance has been disrupted. For example, executive orders that bypass legislative approval, particularly those made in the area of immigration, have raised concerns about the executive branch overstepping its authority and infringing upon the role of Congress. Executive orders shall be used during national emergencies, for enforcing existing laws, or to organize the executive branch. Executive orders should not bypass the legislative process, create new laws, or infringe upon citizens’ constitutional rights.
4. Failure to Provide Equal Protection under the Law:
- The Fourteenth Amendment guarantees that no state shall deny any person equal protection of the laws. Despite this, there are continued systemic issues of racial inequality, particularly in law enforcement practices, such as the disproportionate targeting of Black Americans by police. High-profile incidents like the Ferguson unrest in 2014 demonstrate ongoing civil rights violations that directly challenge the constitutional commitment to equal protection.
5. Government Overreach in the Economy:
- The Tenth Amendment grants powers not specifically given to the federal government to the states or the people. However, federal actions, such as excessive corporate bailouts and government interference in markets (such as healthcare and finance), could be seen as infringing upon the rights of states and individuals to govern themselves and manage their own affairs.
Proposal for Action:
1. Widespread Mobilization:
- Begin organizing through grassroots efforts in every state, focusing on a broad coalition of citizens who share concerns over the government’s constitutional violations.
- Leverage social media, town hall meetings, and peaceful protests to raise awareness and encourage citizens to join the movement.
2. Public Petitioning and Collective Action:
- Create a national petition demanding that the U.S. government be held accountable for constitutional violations. (i.e. this petition you’re reading)
- Advocate for a Constitutional Oversight Committee within the government, comprised of independent citizens, legal experts, and lawmakers, to investigate allegations of constitutional violations and recommend actions.
