We, the undersigned residents of Richards Bay and the City of uMhlathuze, hereby submit this petition to formally raise serious and ongoing concerns regarding air pollution, with particular reference to:

Coal dust fallout

Industrial particulate emissions

Dry bulk cargo handling emissions

The cumulative health and environmental impacts thereof

This petition calls for urgent intervention, independent assessment, transparency, enforcement, and accountability from the relevant authorities.

2. BACKGROUND & COMMUNITY IMPACT

Richards Bay is home to major industrial activities, including port operations, dry bulk handling, heavy transport routes, and processing facilities. While industry plays a role in economic development, this cannot come at the expense of public health, environmental integrity, and constitutional rights.

For several years, residents have experienced:

Visible coal dust and industrial dust settling on homes, vehicles, gardens, outdoor furniture, and washing

Persistent dust exposure during dry and windy conditions

Respiratory discomfort, sinus irritation, headaches, coughing, and eye irritation

Damage to vegetation and outdoor infrastructure

Ongoing fear regarding long-term health impacts, particularly for children, the elderly, and individuals with pre-existing respiratory conditions

Despite repeated complaints from residents, meaningful and sustained corrective action remains inadequate.

3. LEGAL & CONSTITUTIONAL FRAMEWORK

This petition is grounded in South African law, including but not limited to:

3.1 Constitution of the Republic of South Africa, 1996 Section 24 guarantees everyone the right to an environment that is not harmful to their health or well-being, and to have the environment protected through reasonable legislative and other measures.

Section 10 affirms the right to human dignity, which is compromised when residents are forced to live under persistent pollution.

Section 27 protects the right to health care, which is directly undermined by environmental pollution.

3.2 National Environmental Management: Air Quality Act (Act 39 of 2004)
Requires municipalities to prevent and manage air pollution.

Mandates monitoring, enforcement, compliance inspections, and public reporting.

Places a duty of care on polluters� polluters to prevent pollution and remediate harm.

3.3 Municipal Responsibilities

The City of uMhlathuze is legally obligated to:

Implement effective air quality management systems

Enforce compliance with emission standards
Act decisively against non-compliant industries

Ensure transparency and public participation

4. KEY ISSUES OF CONCERN

We raise the following critical concerns:

Coal Dust Pollution

Dust emissions linked to port operations, storage, and transport of coal and dry bulk materials.

Inadequate containment, suppression, and mitigation measures.

Industrial Particulate Emissions

Ongoing emissions affecting nearby residential areas.

Insufficient visible enforcement or consequences for offenders.

Monitoring & Transparency Deficiencies

Air quality data is often inconsistent, inaccessible, or disputed.

Lack of independent, publicly verifiable testing.
Limited community feedback or corrective follow-through.

Health & Environmental Risk Chronic exposure risks ignored or minimised.

Absence of cumulative impact assessments on residential communities.

5. OUR DEMANDS

We hereby formally demand that the City of uMhlathuze, together with relevant provincial and national authorities:

Commission an Independent Air Quality Assessment

Conducted by a truly independent, accredited body

Covering particulate matter (PM10, PM2.5), coal dust, and industrial emissions

With results publicly released and explained to residents

Audit All Industrial & Port-Related Emission Sources
Including coal handling, storage, transport routes, and processing facilities

Assess compliance with existing permits and legislation

Strengthen Enforcement & Compliance Action
Issue compliance notices, fines, and prosecutions where applicable

Suspend operations where persistent non-compliance is identified

Improve Dust Suppression & Containment Measures
Mandatory covering, sealing, misting, and containment of dust-generating materials

Continuous monitoring during high-risk weather conditions

Establish Transparent Public Reporting

Regular publication of air quality data in accessible language

Community engagement sessions explaining findings and actions taken

Protect Community Health
Acknowledge the lived experiences of residents
Implement preventative measures rather than reactive responses

6. CONCLUSION

Residents of Richards Bay should not be forced to choose between economic activity and their right to breathe clean air.
