Abolish the Photography Restriction on PATH!
The Issue
The Port Authority Trans-Hudson (PATH) is a 13.8-mile (22.2 km) rapid transit system in the northeastern New Jersey cities of Newark, Harrison, Jersey City, and Hoboken, as well as Lower and Midtown Manhattan in New York City. The system is owned and operated by the Port Authority of New York and New Jersey.
PATH regulations state that all photography, film-making, videotaping, or creations of drawings or other visual depictions within the PATH system is prohibited without a permit and supervision by a PATH representative. There have been decisions from the United States Supreme Court stating that casual photography is covered by the First Amendment; the case law is mixed. Under the law PATH employees may not force a casual photographer to destroy or surrender their film or images, but confiscations and arrests have occurred (which are both unconstitutional). Given the fact that the system is taxpayer funded, First Amendment Rights SHOULD apply, and yet somehow, they don't. Litigation following such confiscations or arrests have generally, but not always, resulted in charges being dropped and/or damages awarded. Nonetheless, the Port Authority of New York and New Jersey MUST respect First Amendment Rights since the system is taxpayer funded. To make a long story short, photography is not a crime, nor does it have anything to do with terrorism or 9/11.
