• The idea

 

Irregular migration is not always a crime — in many cases, it is a cry for help from young people who have been deceived, exploited by traffickers, or driven by extreme poverty and social hardship.

Although Egypt’s Law No. 82 of 2016 focuses on punishing smugglers and human traffickers, the victims themselves often face harsh measures instead of receiving the humanitarian and legal protection they deserve.

This petition calls for a shift in how the state views irregular migrants — from “criminals” to victims who need protection, rehabilitation, and care.

Many countries, such as Italy, Spain, and Portugal, treat irregular migrants as victims if exploitation or coercion is proven, providing psychological, legal, and social support instead of imprisonment or fines.

 

• Petition Goals

1. Enact a clear Egyptian law that protects victims of irregular migration from criminal penalties if they were deceived, exploited, or threatened.

2. Establish care and shelter centers for rescued migrants, offering medical, psychological, and legal assistance instead of detention.

3. Require authorities to document human trafficking and smuggling cases and investigate the real perpetrators — the brokers and organizers — rather than punishing the victims.

4. Provide social reintegration programs and job opportunities for returning youth to prevent repeated migration attempts.

5. Launch awareness campaigns in rural and underprivileged areas to highlight the dangers of irregular migration and how to avoid traffickers.

6. Apply international human rights standards, following European models that recognize victims as exploited persons rather than offenders.

 

In conclusion, we call for the “Protection, Not Punishment” Law — a law that upholds the rights of irregular migration victims and prosecutes real human traffickers, turning justice into reality, not just a slogan.

 

 

• الفكرة

الهجرة غير الشرعية ليست دائما جريمة… في معظم الأوقات هي صرخة استغاثة من شباب اتخدعوا، أو اتعرضوا لاستغلال التجار والسماسرة، أو هربوا من فقر شديد ومخاطر اجتماعية.

ورغم إن القانون المصري رقم 82 لسنة 2016 ركّز على معاقبة المهربين وتجار البشر، إلا إن الضحايا نفسهم غالبًا بيواجهوا إجراءات قاسية بدل توفير حماية إنسانية وقانونية لهم.

الفكرة هنا هي تحويل نظرة الدولة لضحايا الهجرة غير الشرعية من مجرمين… إلى ضحايا يحتاجون للحماية، والتأهيل، والرعاية.

دول كثيرة (زي إيطاليا، إسبانيا، البرتغال) بتتعامل مع المهاجرين غير الشرعيين كضحايا لو ثبت الاستغلال أو الإكراه، وبتقدّم دعم نفسي وقانوني واجتماعي بدل السجن أو الغرامة.

 

• أهداف العريضة

 1. إصدار قانون مصري واضح يضمن حماية ضحايا الهجرة غير الشرعية من العقوبات الجنائية إذا ثبت تعرضهم للخداع أو الاستغلال أو التهديد.

 2. إنشاء مراكز رعاية وإيواء للمهاجرين الذين يتم إنقاذهم، تقدم لهم الدعم الطبي، النفسي، والمشورة القانونية بدل احتجازهم.

 3. إجبار السلطات على توثيق حالات الاتجار بالبشر والتهريب، والتحقيق مع السماسرة والمنظمين الحقيقيين بدل الاكتفاء بالضحايا.

 4. توفير برامج تأهيل اجتماعي وفرص عمل للشباب العائدين، حتى لا يُضطروا للهرب مرة أخرى.

 5. إطلاق حملات توعية في القرى والمناطق الفقيرة تشرح مخاطر الهجرة غير الشرعية وطرق الحماية من السماسرة.

 6. تطبيق المعايير الدولية لحقوق الإنسان، أسوة بدول أوروبية تعامل الضحايا كـ “متعرضين للاستغلال”، وليس كمجرمين.

 

ختامًا… نطالب بقانون «حماية لا عقاب» الذي يصون حقوق ضحايا الهجرة غير الشرعية، ويلاحق المتورطين الحقيقيين في الاتجار بالبشر، ليصبح العدل واقعًا لا شعارًا
