We, the undersigned, urgently call upon the Prime Minister of Malaysia (PMX), Malaysian Members of Parliament, Attorney General's Chambers, Ministry of Education, Ministry of Home Affairs and Sabah State Legislative Assembly, to enact a comprehensive anti-bullying legislation known as the "Zara Law" in honor of 13-year-old Zara Qairina Mahathir from Papar, whose tragic death has exposed critical gaps in our current legal framework for protecting our children from bullying in our educational institutions.
THE TRAGIC CATALYST | ZARA'S STORY
The heartbreaking death of Zara Qairina Mahathir, allegedly due to relentless bullying at her boarding school, represents a profound failure of our system to protect our most vulnerable citizens - our children. The Borneo Post reports (August 10, 2025) that Zara's death was "not by accident or natural causes, but by the deliberate and sustained cruelty of her peers, compounded by the apparent inaction of those entrusted with her safety and well-being."
The circumstances surrounding Zara's death have revealed disturbing patterns of negligence, denial, and attempts to suppress the truth. While Malaysia recently enacted the Penal Code (Amendment) Act 2025 and Criminal Procedure Code (Amendment) Act 2025 in July 2025, introducing Sections 507B to 507G addressing cyber bullying, threatening communications, and doxing, these amendments primarily focus on digital harassment and general bullying scenarios.
KEY LIMITATIONS OF CURRENT LAWS:
No Mandatory Reporting Requirements: School staff are not legally required to report bullying incidents.
Insufficient Institutional Accountability: Schools face no specific penalties for failing to prevent or address bullying
No Cover-up Penalties: No specific provisions penalizing attempts to hide or suppress bullying incidents
Limited Victim Protection: Inadequate safeguarding measures for affected students
No Prevention Mandates: No legal requirement for schools to implement anti-bullying education programs
Enforcement Gaps: Current laws lack specific enforcement mechanisms for educational settings
THE PROPOSED ZARA LAW | COMPREHENSIVE PROTECTION
The Zara Law would introduce Sections 507H to 507M to the Penal Code (Amendment) Act 2025, specifically addressing school-based bullying with these critical provisions:
Section 507H: Mandatory Reporting
- All school staff must report bullying incidents within 24 hours
- Failure to report: Fine up to RM10,000 and/or imprisonment up to 6 months
- Protection for whistleblowers reporting in good faith
Section 507I: Criminal Consequences for Perpetrators
- Enhanced penalties for bullying in educational settings
- Graduated consequences based on severity and repeat offenses
- Mandatory counseling and community service for juvenile offender
Section 507J: Institutional Accountability
- Schools must implement comprehensive anti-bullying policies
- Regular training mandatory for all staff
- Failure to comply: Institutional fines up to RM100,000
- Potential license suspension for repeated failures
Section 507K: Cover-up Penalties
- Specific criminal offense for concealing or suppressing bullying incidents
- Applies to administrators, teachers, and education officials
- Fine up to RM50,000 and/or imprisonment up to 2 years

WHY ZARA LAW URGENTLY NEEDED
