The Issue
I have known Demetrius Snell since 2007, and after reconnecting with him in 2024, I discovered the harsh reality of his wrongful conviction and the unjust life sentence he is currently serving. Deeply concerned, I took it upon myself to research and review the records of his case. After meticulously assessing the available information and reflecting on his character, I hold an unshakeable belief that Demetrius has been severely mistreated by the justice system.
In a significant turn of events, new evidence has emerged in Demetrius's case. The co-defendant, whose testimony played a crucial role in Demetrius’s conviction has recanted the original statement in 2024. This pivotal piece of information justifies a re-evaluation of Demetrius’s case. Yet, despite these critical new developments, justice hasn’t been served. Demetrius Snell was subjected to racial profiling during the course of his investigation and trial. The victim’s sworn affidavit identified one of the perpetrators as a tall Black male approximately 6’0” to 6’1” tall with multiple inconsistencies.
Despite this, Mr. Snell was prosecuted and tried before a jury that did not reflect a fair cross-section of his community, consisting predominantly of middle-aged and older white jurors. During the trial process, Mr. Snell observed his defense attorney interacting in a friendly and unprofessional manner with the prosecuting attorney, raising concerns about the adequacy of his legal representation. Furthermore, Mr. Snell was identified in court by these factors that collectively suggest the presence of racial bias, ineffective counsel, and procedural unfairness, which warrant a thorough review of his conviction.
In addition, Mr. Snell was improperly sentenced under Florida’s Prison Releasee Reoffender (PRR) law, despite his prior juvenile-related history not qualifying for such an enhancement. This misuse of the PRR statute resulted in an excessively harsh sentence that fails to align with Florida’s statutory requirements and sentencing fairness standards.
Moreover, the court ignored newly discovered evidence, including the recantation of Mr. Snell’s co-defendant, who has since sworn that Mr. Snell was not involved in the alleged offense. This crucial affidavit directly undermines the integrity of the original conviction and supports his claim of innocence.
Demetrius has been unlawfully sentenced to life in prison for a crime he did not commit. He continues to serve a life sentence for a crime in which he was never positively identified as the perpetrator, taken 10 plus years of his youth.
