Woodland Terrace Mobile Home Park and Tenants want to remain a Mobile H. Park

The Issue

Residents of Woodland Terrace Protest of Notice of Evacuation if property is sold

1.      Residents of Woodland terrace have not signed or agreed to terminating their occupancy.

2.      There was a Notice placed on every door stating that we may have to move our mobile home under new ownership.

3.     Furthermore, 95% of residents living here do not have the finances to move their mobile home. Also, some of the older homes might not be in the condition to take the move.

4.     The approximate cost to move a mobile home and setup is between $6000 to $10,000.

5.     There are no places or parks that will take older mobile homes.  The current policy in other Mobile Home Parks is to take newer models dating  2000 or newer, no older homes.

6.     People would become homeless, if forced to move their home.

7.     They are older mobile homes, but it is a home to someone.

8.     The state code reads that if more than 25 tenants can’t be evicted within a eighteen month period: (Read code below)

West Virginia State Code:
§37-15-6a. Termination of tenancy of more than twenty-five tenants.

    (a)A landlord of a factory-built home rental community may not terminate a rental agreement nor otherwise evict more than twenty-five tenants of any factory-built home rental community within a single eighteen-month period.  

      (1) The landlord obtains written agreement to voluntarily vacate the premises by every tenant prior to the expiration of the eighteen­ month period unless:

(2)The landlord provides not less than six months' notice to terminate the rental agreement to each tenant; or

(3) The tenant has breached a provision of the rental agreement and the termination complies with the requirements of this article.

(b)If a landlord violates the provisions of this section, the tenant has a cause of action to recover actual damages, the costs required to relocate the aggrieved tenant and, in addition, a right to recover treble damages or the equivalent of the aggrieved tenant’s rent for one year, whichever is greater, and reasonable attorney fees.
