Women in Indian occupied Kashmir: A Call for Justice and Solidarity on Women's Day

The Issue

On this International Women's Day, it is imperative that we unite to shed light on the challenges faced by women residing in conflict-ridden areas, particularly in regions like Indian Occupied Jammu and Kashmir (IOJK). Women in these territories confront heightened levels of violence, discrimination, and limited access to fundamental rights and resources. The weaponization of gender and sexuality for colonial control exacerbates gender-based hardships, blurring distinctions in vulnerability during genocidal events. It is essential to foster global solidarity and advocate for the well-being of women worldwide, especially those enduring severe violence and military occupation.

Join the movement through collective action, advocacy, and global solidarity, we can work towards creating a more just and inclusive world where all women are empowered to live free from violence, discrimination, and oppression. Let us unite in support of the rights and welfare of women in IOJK by endorsing petitions and championing their cause for a brighter future.

Women's Struggle for Self-Determination in Kashmir and Palestine:

Women in Kashmir and Palestine grapple with a deeply ingrained system of oppression  perpetuated by de-facto governmental institutions and policies. This systemic injustice deprives them of basic human rights such as education, healthcare, and employment opportunities while subjecting them to violence, harassment, and abuse.

The situations in both Kashmir and Palestine underscore a severe breach of international human rights laws and International Humanitarian law, particularly concerning the widespread sexual violence and oppression endured by women in these conflict-affected regions. These violations starkly contradict fundamental principles outlined in international conventions and treaties. Despite enduring such hardships, women in Kashmir and Palestine have displayed remarkable resilience, actively participating in movements for self-determination alongside men.

The experiences of Kashmiri and Palestinian women underscore the urgent need for legal safeguards and accountability mechanisms to address the multifaceted challenges they face within the realm of international law.

Urgent Call for Justice:

The Kunan Poshpora incident in Kashmir exemplifies the normalization of rape as a weapon in Indian-Occupied Jammu and Kashmir (IOJK). This incident involved mass sexual assault by the Indian occupying army on around 100 women, shedding light on the brutal use of sexual violence in the region. The aftermath of the Kunan Poshpora incident unveiled the fear and reluctance of women in Kashmir to report such war crimes due to the risk of reprisals. Furthermore, the arbitrary detention of female political prisoners in Kashmir has significantly impeded women's activism, perpetuating a cycle of brutality and marginalization that necessitates attention, especially on Women's Day

Prominent figures in the Kashmir resistance movement such as Asiya Andrabi, Nahida Nasreen, and Sofi Fehmeeda are currently detained in India's notorious Tihar Jail as high-risk detainees. The plight of these individuals underscores the urgent need to address the systemic challenges faced by women activists in Kashmir and advocate for their rights and freedoms.

The recent wave of persecution in Kashmir following illegal annexation exemplifies neocolonialism, emphasizing the importance of upholding human rights and ensuring fair treatment for all individuals regardless of their background or beliefs. The Indian government's termination of female employees in Kashmir without due process violates their fundamental rights including their right to protection under the law, work, and earn a livelihood. The series of terminations is part of a government crackdown initiated in August 2019 against employees suspected of involvement in anti-India activities. The Indian occupying authorities are invoking a provision in Article 311 of the Indian Constitution that allows dismissal without inquiry "in the interest of state security." However, as an ‘occupier,’ the Indian government is obligated to safeguard the rights of all its citizens, including women, ensuring they are not subjected to discrimination or oppression.

The lack of accountability and prosecution for these violations has perpetuated a culture of impunity within the state apparatus. The failure to hold occupying authorities including Indian armed forces accountable for such abuses signals tolerance if not endorsement of these practices by Indian occupying authorities.

In conclusion, as we commemorate International Women's Day, it is imperative for the global community to recognize and address the specific challenges faced by Kashmiri women in their pursuit of self-determination. The plight of Kashmiri women must not be overlooked any longer; their rights must be upheld with equal fervor as those of women in other conflict-affected regions. It is high time for the international community to stand in solidarity with Kashmiri women, ensuring they are treated fairly with their voices heard and respected.

Justice must prevail; all forms of violence against Kashmiri women must be condemned and eradicated. It is essential to create a safe and inclusive environment where these women can actively participate in shaping their future without fear or discrimination.

On this Women's Day, let us reaffirm our commitment to supporting the aspirations and demands of Kashmiri women, advocating for their rights, and working towards a peaceful resolution that honors their resilience and determination. Together, we can strive towards a more just and equitable world for all.
