The federal government is days away from enforcing a rule that could push immigrant families to choose between medical care and their future in this country. Starting September 18, the Department of Homeland Security's expanded "public charge" rule lets officials deny green cards and visas to immigrants who have used public benefits like Medicaid, SNAP, children's health coverage, or subsidized school lunches, even benefits used only by their U.S. citizen kids.

New York City Mayor Zohran Mamdani, joined by Attorney General Letitia James and a coalition of 22 states, is suing to stop it. "None of this is abstract. People could die as a result of these changes," Mamdani said, according to a September 2026 press conference reported by Documented. City officials estimate the rule could push up to four million people, including 1.8 million children, off health coverage they qualify for.

This isn't a partisan issue. Families who came here legally and are raising citizen children shouldn't have to weigh a school lunch against their immigration case. Community organizations in Queens are already seeing food pantry lines shrink, not because the need went away, but because fear moved in.

The Department of Homeland Security should withdraw this rule before it takes effect. No parent should have to choose between feeding their child and staying in this country.
