We Were Misled – Urging Law Reform to Protect All Malaysian Consumers

The issue

We urge the Malaysian government to amend the Consumer Protection Act 1999 to address serious loopholes that allow businesses to engage in misleading advertising without accountability, especially in the growing space of social media commerce.

In 2024, a popular social media influencer advertised a “Ritually blessed jade” necklace on Instagram, claiming it to be “18K real gold and real diamonds”. Buyers had to pay a deposit before even being allowed to inquire about the product.

Later, it was revealed that the so-called “real diamonds” were actually lab-grown diamonds. The seller never clearly stated this, and even insisted it was “real diamond” when asked.

In January 2025, after public exposure, the seller admitted the diamonds were lab-grown. Many customers only realized the truth then and demanded refunds. However, because the necklaces had been worn, refunds were refused on the grounds of “used item”.

This is fundamentally unfair, and it shows how current laws fail to protect consumers from misleading sales tactics.

We demand legislative changes to:

- Clearly define vague or misleading sales language as illegal;
- Require sellers to disclose product attributes (e.g. natural vs lab-grown diamonds);
- Protect consumers’ rights to refund or file claims even after use, if misled at the point of purchase;
- Regulate social media sales and establish mandatory standards for advertising and product descriptions.

We are not legal experts. We are everyday consumers who trusted a seller and were misled. We demand fair laws that truly protect us.

我们呼吁政府立即修订《消费者保护法令1999》(Consumer Protection Act 1999),以堵住现有法律在“误导性销售宣传”方面的漏洞。

然而,多位消费者事后才发现,该“真钻”实际为“培育钻石”,并非天然钻石。在购买时,商家未曾如实说明,甚至在被询问时仍坚持称为“真钻”。

2025年1月,在舆论揭发后,该卖家才承认所售为培育钻石。许多消费者直到那时才意识自己被误导,纷纷要求退款。然而,因商品曾被佩戴,商家以“使用过”为由拒绝退款。

我们认为这是法律漏洞造成的不公平!消费者在不知情情况下被误导,理应受到保护!我们要求政府修法,重点如下:

明确“含糊或误导性用词”属违法行为;

  • 要求商家在销售中清楚说明产品属性(如天然或培育钻);
  • 保障消费者在“被误导购买”的情况下,即使商品使用过,仍享有退货索赔权;
  • 监管社交媒体销售行为,设立广告宣传与销售话术的底线规定。

我们不是法律专家,但我们是信任商家与平台的普通消费者。我们要求公平、透明的法律制度来保护我们!
