The Issue
Community Petition:
We wish to bring to your attention the planned construction of Surau Al-Jabbar on Lot 24462 in Taman Kajang East, Pekan Semenyih, Hulu Langat. Notably, within a 2km radius of Semenyih Indah, there are already 25 Surau (exist 21 suraus + 4 coming soon) and 1 mosque - representing 6.5% of all prayer facilities in Hulu Langat District.
As long-standing residents of Semenyih Indah, we earnestly propose reallocating Lot 24462 for development as a public park and recreational facility - a resource urgently needed by our children and elderly. This initiative seeks to improve community wellbeing while preserving social harmony among all residents.

Residents Voice:
1. Poor Condition of Recreational Facilities and Spacious Playground:
The playground facilities are in extremely poor condition and dirty, with many devices worn out or broken or rusty, posing safety hazards, especially for children and the elderly. Kajang East lacks spacious, well maintained and safe parks or playgrounds for children and senior citizens. Residents, including the elderly and children, have no proper space to exercise or socialize with their families. Compared to Setia EcoHill-South Greek, Kajang East has significantly fewer recreational facilities.
2. Existing Regions Infrastructure and still got a lot Tanah Kosong:
Existing 21 Surau and 1 Mosque around LoT 24462 within radius 2km ( base on google map). 4 coming soon Surau and still got a lot Tanah Kosong in Semenyih Indah:

3. Community Impact Issues:
- The residents are worried the traffic will become congested and they will have difficulties to access the solo entrance into Kajang East Precinct (KEP). KEP3 has new row of shops, in the future may also contribute more traffic jam. Maybe not that suitable to build at that place.
- Concern sleep deprivation getting worst. Some residents are light sleeper and suffered from sleeping disorder where they are sensitive to sound.
- Worry Safety issues around the region will degrade. The visitor status is more complex to identify. It will cause local security facing the challenge to recognize they are Resident, visitor or Intruder.
4. Urban Planning Concerns:
- Town plan not align with community needs. Town Council Master Plan should sensitive, update and change based on Residents' needs and suitable with current social evolution. Kajang East Precinct is not a new town. It is already 8 years old. Why still use the 8 years ago master plan? Officer who approved the project might not familiar to Semenyih Indah culture and lifestyle, he is welcome to visit us in Semenyih Indah.
- Property owners and residents have verified with the Department of Town and Country Planning Malaysia (2024) that Lot 24462 is officially designated as 'Vacant Land' (colored green) as of October 2024, as shown in the following image.
- We have consulted our legal team regarding the Sale and Purchase Agreement (S&P) and found no mention of Lot 24462 being designated for religious purposes. Given that its status is "Vacant Land," we respectfully request that it be repurposed as a playground for children and senior citizens.
- Residents and homeowners do not understand why JAIS did not apply for Lot 24462 in 2015, but only in 2020. Had JAIS applied in 2015, the 1,435 homeowners/residents would not have purchased properties in Semenyih Indah, avoiding this petition and dispute. 2020 was during Malaysia's Movement Control Order (MCO), when residents were restricted from going out and were unaware of this application. Additionally, Lot 24462 is in a hidden location, making it unlikely for the public to notice the planned surau construction. This is not the way a Madani Government should operate.
- According to the Malaysia Department of Town and Country Planning (2024), three land lots have already been allocated for surau construction in Semenyih Indah. These lots are located just 300 meters left and right of Lot 24462:

Lot 43149 - According to the Guidelines for the Construction and Registration of Mosques and Surau in Selangor State, the required distance between surau facilities is 2 kilometers. However, the four upcoming surau will be situated only 300 meters apart from each other and 300 meters from existing surau, which violates these regulations.
- According to GPP Rumah Ibadat Isalm 2023 Jabatan Perancangah Bandar dan Desa. 5,000 residents for a Masjid Kejiranan and 2 Surau Kejiranan. but now we got 25 surau in small area of 4 sq/KM. Do we have 5000 residents?
5. Demographic Considerations:
- 80% mostly of the residents around Semenyih Indah are Chinese and Indian.
- The Construction was not discuss and there is no survey done with the local communities and AJK. Never ask for our opinion. Study was not conduct whether the facility is suitable or beneficial or needed by local communities and residents.
6. Risk of Structural Damage to Nearby Homes:
- Soil Stability & Vibration Risks. Heavy construction machinery and pile-driving activities may cause ground vibrations, worsening existing house cracks in the area. Nearby residents have reported increased structural stress on their properties from ongoing developments.
- High Density of Residential Units. The proposed site is surrounded by tightly packed homes, making it risky for deep foundation work. Vibrations from construction could weaken the structural integrity of older houses.
- No Prior Geological Assessment. No soil tests or impact studies were conducted to evaluate risks to nearby homes. Residents fear foundation shifts and wall cracks will worsen if construction proceeds.
- Past Complaints Ignored. Homeowners have previously reported new cracks appearing after nearby construction projects. No mitigation measures were taken, leaving residents vulnerable to long-term property damage.

Our Humble Request:
We propose:
- Converting Lot 24462 into a green community space
- Relocating surau plans to designated alternative plots
- Conducting proper community consultation per Madani governance principles

- Multiple reports filed (SISPAA, JAIS, MPKJ) on August 2024. We requested stop the construction and application form till meeting is conducted and final decision is concluded.

- We would like to emphasize that our concerns are not directed against any religion or community to build a Surau. Our position is solely based on the inappropriateness of this location for another surau. Our community's pressing need is for recreational spaces where our children can play and our elderly can enjoy outdoor activities. We seek only fair urban planning that serves all residents
- We are anak Malaysia. We believe our Madani government will create a harmonious and peaceful environment for all citizens.
- We do not allow violence, hate, exploitation, bullying and harassment, etc speech.

- We would like to emphasize that our concerns are not directed against any religion or community to build a Surau. Our position is solely based on the inappropriateness of this location for another surau. Our community's pressing need is for recreational spaces where our children can play and our elderly can enjoy outdoor activities. We seek only fair urban planning that serves all residents
- We are anak Malaysia. We believe our Madani government will create a harmonious and peaceful environment for all citizens.
- We do not allow violence, hate, exploitation, bullying and harassment, etc speech.

作为士毛月英达的长期住户,我们诚恳建议将24462号地块改建为当前社区亟需的公共公园及休闲设施,以服务儿童及长者群体。此项提议旨在提升社区福祉,同时维护各族居民的和谐共处。

居民心声:
1. 状况恶劣, 严重缺乏休闲设施:
游乐场设施状况极其恶劣且肮脏不堪,许多设备严重磨损、破损或生锈,存在重大安全隐患,尤其对儿童和老年人构成威胁。加影东部地区缺乏宽敞、维护良好且安全的儿童及老年公园或游乐场。当地居民,包括老人和儿童,根本没有合适的空间进行锻炼或与家人社交互动。与Setia EcoHill-South Greek相比,加影东部的休闲娱乐设施数量明显不足。。
2. 现有区域基础设施情况,Tanah Kosong 仍然有很多:
LoT 24462 周围 2 公里半径范围内有 21 个祈祷室和 1 个清真寺。Semenyih Indah 即将新增 4 个祈祷室。Tanah Kosong 仍然有很多:

3. 社区影响问题;
- 居民担心交通会变得拥堵,难以进入加影东区(KEP)的单独入口。KEP3 新建了一排商店,未来可能会加剧交通拥堵。该地可能不太适合建房。
- 担心睡眠不足问题会加剧。一些居民睡眠浅,患有睡眠障碍,对声音敏感。
- 担心该地区的安全问题会恶化。访客身份识别更加复杂,这将导致当地安全部门难以识别他们是居民、访客还是入侵者。
4. 城市规划问题:
- 城镇规划与社区需求不符。市镇理事会总体规划应根据居民的需求进行敏感度、更新和调整,并适应当前的社会发展。加影东区并非新镇,它已有 8 年历史。为什么还要沿用 8 年前的总体规划?批准该项目的官员可能对士毛月英达不熟悉,欢迎他来士毛月英达参观。
- 业主和居民已向马来西亚城乡规划部(2024)核实,Lot 24462 自 2024 年 10 月起正式被指定为“空置土地”(绿色),如下图所示。
- 我们已就买卖协议(S&P)咨询了我们的法律团队,未发现任何关于 Lot 24462 被指定用于宗教用途的条款。鉴于其状态为“空置土地”,我们恳请将其改建为儿童和老年人的游乐场。
- 居民和房主不明白为什么JAIS没有在2015年申请Lot 24462,而直到2020年才申请。如果JAIS在2015年提出申请,1,435名房主/居民就不会在士毛月英达购买房产,从而避免这次的请愿和纠纷。2020年正值马来西亚行动管制令期间,居民被限制外出,对这项申请毫不知情。此外,Lot 24462地段位置隐蔽,公众不太可能注意到计划中的祈祷室建设。这不是迈达尼政府应该采取的运作方式。
- 根据马来西亚城乡规划局(2024)的资料,士毛月英达已有三块地被分配用于建设祈祷室。这些地块位于 24462 地块左右两侧仅 300 米处:

地块 43149 - 根据雪兰莪州清真寺及祈祷室的建设和注册指南,祈祷室设施之间的距离要求为 2 公里。然而,即将建成的四座祈祷室彼此之间仅相距 300 米,距离出口也仅 300 米。
- 根据GPP Rumah Ibadat Isalm 2023,Jabatan Perancangah Bandar dan Desa的数据,5000名居民原本只能建造一座清真寺和两座祈祷室,但现在只有25座。
5. 人口因素:
- 士毛月英达 (Semenyih Indah) 周围80%的居民是华人和印度人。
该项目并未进行讨论,也没有与当地社区和AJK进行调查。从未征求我们的意见。该项目是否合适、有益或当地社区和居民是否需要,也未进行研究。
6. 附近房屋结构损坏风险:
- 土壤稳定性和振动风险。重型建筑机械和打桩活动可能会引起地面振动,加剧该地区现有的房屋裂缝。附近居民报告称,正在进行的开发项目增加了他们房屋的结构压力。
- 住宅单元密度高。拟建场地周围房屋密集,深层地基施工存在风险。施工产生的振动可能会削弱老旧房屋的结构完整性。
- 未进行事前地质评估。未进行土壤测试或影响研究来评估对附近房屋的风险。居民担心,如果继续施工,地基会移位,墙体裂缝会加剧。
- 忽视过往投诉。此前,业主曾报告称,附近的施工项目后出现了新的裂缝。由于未采取任何缓解措施,居民容易遭受长期财产损失。
