Stop the World Health Organization's Power Grab!
The Issue
The World Health Organization is working towards adopting amendments to the International Health Regulations (IHR) of 2005 and a pandemic treaty designed to usurp state and local level management of pandemics. One of the amendments to the IHR will change recommendations from "non-binding" to "binding". Another amendment removes the phrase "with full respect for the dignity, human rights and fundamental freedoms of persons" from the regulations. The treaty seeks to allow WHO member states to tackle "misinformation or disinformation" against the organization's narratives about pandemics.
American sovereignty is at stake (and so is the sovereignty of all WHO member nations). These amendments and treaty are scheduled to be voted on in May of 2024. The treaty will require a 2/3 vote from WHO member states present at the World Health Assembly (WHA) to be adopted while the IHR amendments require only a simple majority vote from WHO member nations present at the WHA. The treaty and IHR amendments are intended to be adopted WITHOUT a 2/3 vote in the Senate. In 1948, membership of the United States into the WHO was approved by both houses of Congress via a Joint Resolution. President Truman signed the Resolution into law, then signed the WHO Constitution before sending it into the State Department's Depositary. Even though the U.S. Senate did not provide a 2/3 vote of consent on this, membership of the U.S. in the WHO is treated as a treaty.
Our county commissioners must act NOW to interpose against this. Article Six of the Constitution is often misrepresented to mean that any action by the Federal Government overrides state and local laws and ordinances. However, the actual language of the article is as follows: "This Constitution, and the laws of the United States which shall be made in Pursuance thereof; and all Treaties made, or which shall be made, under the Authority of the United States, shall be the supreme Law of the Land". This means federal laws are only supreme to the states when done in pursuance of the powers vested to the federal government by the Constitution. This is confirmed by Alexander Hamilton, who wrote the following in Federalist #33:
"But it will not follow from this doctrine that acts of the large society which are NOT PURSUANT to its constitutional powers, but which are invasions of the residuary authorities of the smaller societies, will become the supreme law of the land. These will be merely acts of usurpation, and will deserve to be treated as such. Hence we perceive that the clause which declares the supremacy of the laws of the Union, like the one we have just before considered, only declares a truth, which flows immediately and necessarily from the institution of a federal government. It will not, I presume, have escaped observation, that it EXPRESSLY confines this supremacy to laws made PURSUANT TO THE CONSTITUTION; which I mention merely as an instance of caution in the convention; since that limitation would have been to be understood, though it had not been expressed."
Hamilton wrote this in Federalist #78:
"There is no position which depends on clearer principles, than that every act of a delegated authority, contrary to the tenor of the commission under which it is exercised, is void. No legislative act, therefore, contrary to the Constitution, can be valid."
Therefore, the 1948 law providing for membership of the U.S. in the WHO will be used to usurp the 1st, 4th, and 10th Amendments in the U.S. Constitution (and likely other amendments as well). So will the IHR amendments and the treaty. As such, it is imperative that local governments pass ordinances that prohibit enforcement of WHO edicts within their jurisdictions by their departments (for example, health departments cannot be allowed to issue vaccine passports).
Please sign this petition, and after signing, contact the Wayne County Board of Commissioners and urge them to pass a resolution that will defund or restrict funding to county departments that enforce WHO edicts. Whether calling or sending emails to the commission at large, or your individual commissioners, a simple message to send to them could go like this:
"Dear Commissioners,
I am deeply concerned about the WHO's efforts to usurp state and local control of healthcare. The organization is working to adopt a treaty and amendments to the International Health Regulations that will violate the 1st, 4th, and 10th Amendments to the Constitution. However, the IHR amendments and treaty being negotiated are not going to receive a 2/3 vote in the Senate. Therefore, they must be treated as usurpations, and I urge you to pass a resolution defunding or restricting funding for county departments that enforce edicts from the WHO.
Alexander Hamilton, who was an advocate for a strong federal government, wrote in Federalist #33 that lower level governments have the right to treat acts by the federal government that are not pursuant to the Constitution as acts of usurpation. Therefore, passing such a resolution is not only constitutionally justified, but also necessary in protecting the rights of the citizens of this county, and will go a long way toward protecting the sovereignty of the whole nation."
