I propose that we totally revamp state question 780. This has adversely affected programs that do work to help people with addiction and get them on the right track. State question 780 has adversely affected drug courts, because of the charge being changed to a misdemeanor. Drug treatment courts have proved to be successful in other States at reducing crime and actually allowing people to get the help they need and go on to led successful lives. The drug courts are difficult on the offender, but it is not prison. The Judge has all participants sign a performance contract. They get regular substance testing. They do get some disciplinary actions if they miss an appointment or fail or drug test. They are required to have regular appointments with counselors and case managers, group therapy and self improvement activities. They have weekly mandatory court hearings to check progress. He has had a 80 percent success rate. They are three times less likely to be arrested again. The unemployment drops by 95 percent and the number of children able to live with those who participate in this program is substantial. They end up with an income increase that is staggering compared to those that are just arrested for misdemeanor drug offenses multiple times. Drug felonies have fell by 74.4 percent, but drug misdemeanor's has climbed by 166.3 percent. The felony charge gave people an incentive to go to drug courts. State question 780 has made the punishment so that the maximum penalty is a 1000 dollars and a year in prison. The drug ordered court is more stringent, so they will take their chances. These statistics are taken from KOSU /npr. from an article on January 6, 2022. I propose that people are charged with felonies again if caught with methamphetamine and ordered to drug court. The savings from fewer people in prison could fund this. The money that was supposed to go to mental health and drug addiction services improvement would work hand in hand with drug court. I am asking for this change in honor of my son's memory. We have fought to get drug dealers off the street. They live comfortably among us and make their living off of nothing but selling meth that they are now lacing with fentanyl. We can not always have a win like that. The only way the dealers can be put in prison is to actually be caught in the act of distribution. The drug dealers are smart and so they carry under the 19 gm, so that they are only given a misdemeanor. We will continue having more meth in our small towns until someone will stand up and fight. I propose that if I can not get enough interest in this petition that we have federal help step in to save our towns in Oklahoma. I truly want to see the people addicted have mental health services and programs to help them, but at the same time some of the ones you may think are just small time users are actually big time dealers that may remind you of your mom or grandmother, just the nice lady next door. They are often store owners and thought to be pillars of the community. They have no fear of being imprisoned as long as we keep question 780.
