WA needs to acknowledge that intoxication affects the ability to consent to sexual acts!

The issue
WA is one of the only jurisdictions in Australia that does not acknowledge how high levels of intoxication affect the ability to consent to sexual activities.
- WHAT needs to happen: The Criminal Code Act 1913 (WA) needs to include a clause that acknowledges how high levels of intoxication remove the ability to consent to sexual activities.
- WHY this needs to happen: WA needs to protect its people from sexual assault that occurs when highly intoxicated victims are taken advantage of. WA is one of the only jurisdictions does not recognise the affects of intoxication on the ability to consent.
- WHERE this matters: All of WA would benefit from this amendment; however, it will particularly help feminine students who attend University.
- WHO it affects: Your friends, colleagues and peers. The people who make WA, WA.
- WHEN we need it: As soon as possible! There was a 10% increase in reported sexual assault cases between 2019 and 2020 in WA. This only accounts for reported cases; sexual assault is one of the most underreported crimes and this legislative gap creates a barrier for victims who are trying to access justice.
- HOW can we achieve this: We need to bring this issue to parliament! By making our politicians aware of this legislative gap there will be more pressure for them to amend the criminal code and provide WA people with the justice and protection they deserve!
