The Issue

My family and I have been living in the shadow of an unjust decision, with the loss of a beloved family member, Delshaun Nix. Delshaun was only a juvenile when he and his co-defendant, Gabrielle Mansour, were convicted for their involvement in 3 and 4 robberies respectively, and an involuntary manslaughter. Their crimes were similar, committed within a whisker of each other - Mansour's spanned two days and Delshaun's a single day. Yet the difference in their sentences is stark and profoundly unfair.

The prosecutors, David Zeyen, James Lowe, and George Tyack, subjected Delshaun to unequal treatment by sentencing him to 20 years in jail while Mansour received only 5. This disparity in sentencing is not just a grievance, it is a violation of our rights to equal treatment under the law. According to the National Institute of Justice in 2017, equal punishment for similar crimes is a fundamental principle of our justice system.

As a direct result of this excessive incarceration, Delshaun was unable to attend the funerals of our family members, including our brother, uncle, father, and aunt. This experience has ripped our family apart, while fueling our fight for justice, fairness, and equality before the law.

Thus, we call upon those involved in this process, particularly the prosecution team and the relevant legal authorities, to reconsider Delshaun's sentence. The prosecutors have made false statements and have placed Delshaun at other crimes that he wasn’t present at, which took place on March 7th and were as his crimes all took place on March 12th. The evidence to support this claim are via police reports, which have been denied by the Columbus Police Department. Our goal is not to make excuses for crimes committed but to seek justice where it has been denied. This effort is more than just about righting a wrong done to Delshaun; it's about setting a precedent where juvenile offenders are treated with equity, fairness, and dignity under the law.

 

This case has been appealed to the 10th District Court of Appeals in Franklin County Ohio were a decision is pending as of 2/26/2025. If the decision made by the court of appeals does not reflect justice for this unlawful treatment, this matter will be continue to be appealed to the next step such as the Ohio Supreme Court and the United States Supreme Court.
