Violating Tenant Rights, Illegal Rent & Parking Increase - Pavilion Towers- Newark, NJ
The Issue
If you are a resident of the Pavilion Towers located in Newark, NJ, and have experienced or currently experiencing any of the following issues, please sign this petition.
We are working with the Pavilion Tenant Association (PTA) and city officials to resolve these issues accordingly.
We will not be silenced until these issues are addressed and corrected:
Rent increase:
Newark is currently on a rent freeze and has been since the start of the pandemic, prohibiting rent increases. Many residents had their rent illegally increased despite the freeze.
2. Parking increase:
Many residents are paying $85-$100 for parking spots when legally we shouldn't be charged more than $40 for a parking spot. If I and other tenants are paying $85-$100 for parking on a monthly basis, we deserve the peace of mind of knowing that our vehicles are safe.
Non-secured parking deck (broken and easily accessible fences):
While parking is set to increase sometime this year, management intends to do nothing about the fence. The property manager even quoted, "There was nothing Pavilion could do about the fence”. This was after my car was about to be stolen or vandalized. Many had their cars broken into while parked in the State Street Parking lot. Not to mention, This fence had been cut open once before. The fence can easily be climbed and destroyed, leaving all residents’ vehicles vulnerable and susceptible to vandalization and theft.
Therefore, why should we pay an increase in parking when our vehicles aren’t truly protected? Increasing parking prices when there is no real security for our vehicles is unethical, egregious, and downright disrespectful for the money residents are paying.
4. Broken elevators on a daily basis:
Only 1 out of 3 working elevators to be exact are working on a daily basis. There are 22 floors per building, leaving many piled up per elevator, which is unsanitary, unhygienic, and inconveniencing. Not to mention, this can cause residents to run late for work, putting them at risk of termination from their respective employers.
5. Illegal $1,000 'Move-In Administration' Fee or $1,250 Transferable Fee:
Many including myself were charged a $1,000 ‘move-in’ administrative fee before moving into our units. I later learned that this is illegal according to Newark's rent control division. Many were never reimbursed for this., including myself. I paid this fee, my security deposit, and 1st month’s rent.
6. Illegal $1,000 'Transferable' Fee:
For residents who are moving from one apartment to the next.
7. Convenience fee:
When making transactions such as paying your rent, parking or gym fee via the resident portal, we are also being charged a convenience fee. The rent and parking are on two different portals which is why we are being charged two different convenience fees.
8. No reimbursement or credit for February 2021 for not having hot water for 14 days:
For tenants who live in the 'B' building, Tiffany Huertas, our Rent Regulation Officer is working on resolving the issue with the owner.
9. Card-Access Only Resident State Street Entrance:
This gate has not been fixed and is currently unlocked. This entrance is supposed to have a card-access lock and be accessible for residents only. This has been ongoing for the past couple of months. Non-residents can walk in, out, and through our complex which compromises resident/staff safety.
10. Gym regulations:
On April 17, 2023, I along with other residents received an email regarding the Gym Regulations, stating residents cannot work out in group settings. This is NOT stated in our fitness agreement/policy. We pay $25 monthly plus a $40 annual fee.
What legal ramifications does Pavilion/Salman Capital have to police our gym activity? Pavilion never specified the exact number of what is considered a group nor stated any reason why we are now prohibited from working in groups. This is a breach of contract and a violation of our rights.
Management informed our PTA president, that the gym is supposedly 'free' for Pavilion Residents.
In closing, we will not be silenced until these issues have been addressed and corrected. These practices are unethical, disgusting, and illegal. Tenants work too hard to receive little to no-quality amenities and be taken advantage of. We will continue to actively and diligently to work receive quality amenities, and ensure resident safety and security. Again, I encourage everyone to exercise their right of Freedom of Speech and express any issues or grievances below.
