Community-First Opening

We, the residents, creatives, promoters, service providers, and business stakeholders of the Vaal region, proudly submit this petition to Halewood South Africa (trading as Belgravia / Red Square) to demand fair recognition, repayment, and ethical engagement for the Belgravia Soul Session, a concept born and nurtured by our community.

It has come to our attention that this concept and event idea is being used in other regions without the involvement, consent, or compensation of the original Vaal community creators. This is both a moral and legal concern, as the intellectual property, creative input, and economic rights of the Vaal community are being exploited.

Our community contributed to the event’s success through effort, resources, and support, yet many contributions remain uncompensated. This petition seeks justice, fairness, recognition, and accountability for the Vaal people.

OUR DEMANDS

1. Repayment for Vaal Contributors – Ensure all local DJs, artists, promoters, concept founders, and service providers are compensated fairly.

2. Return Event Hosting Rights to Local Organisers – Allow the community that created the event to continue hosting it and prevent the concept from being used elsewhere without their consent.

3. Support Local Businesses – Appoint at least 80% Vaal-based service providers; outsource only if necessary.

4. Fair Compensation for Local Artists and Promoters – Ensure payment reflects effort, skill, and contribution.

5. Transparency in Event Management – All revenues and costs must be communicated to local stakeholders.

6. Community Engagement and Protection – Respect the community’s role in nurturing creative concepts.

7. Notice of Intent to Boycott – If demands are not met by Belgravia / Red Square (Halewood), the Vaal community reserves the right to initiate a lawful boycott of their products in the Vaal region. Our demands are centered on addressing inequality and ensuring the community receives recognition and fair economic treatment.

We urge all residents and businesses in Vaal to join us in this effort for justice and economic fairness.

LEGAL BASIS AND EXPLANATION

1. Constitution of the Republic of South Africa, 1996 (Sections 18, 22, 23, 25, 27, 195)

Section 18: Guarantees freedom of association and collective action, allowing communities to organize and petition.

Section 22: Protects the right to choose a trade, occupation, or profession.

Section 23: Ensures fair labour practices, supporting fair compensation claims.

Sections 25 & 27: Protect property rights and access to resources, including creative outputs.

Section 195: Upholds transparency, accountability, and ethical conduct.

2. Copyright Act, 1978

Protects original works and creative concepts. Unauthorized use of the Belgravia Soul Session concept in other regions without consent constitutes infringement.

3. Consumer Protection Act, 2008

Safeguards contributors from unfair, misleading, or exploitative practices.

4. Companies Act, 2008

Requires ethical and transparent corporate governance.

5. Competition Act, 1998

Supports local business inclusion and prevents exclusionary practices.

6. Labour Relations Act, 1995

Ensures workers, freelancers, and service providers are treated fairly.

7. Lawful Collective Action / Boycott (Constitution Section 18)

Confirms the right to peaceful collective action, including boycotts, when demands for fairness and accountability are ignored.

Legal Stand on Misuse of the Concept:

The Vaal community has full rights to the concept under Copyright Act, 1978. Unauthorized use elsewhere without consent or compensation is illegal and infringes intellectual property rights.

The petition asserts the community’s right to ownership, recognition, and remuneration whenever their creative ideas are applied.

COMMUNITY SUPPORT STATEMENT

The Belgravia Soul Session was uplifted, supported, and sustained by the Vaal community, including residents, attendees, local businesses, and grassroots contributors. This petition represents the voice of the community, seeking accountability, fairness, and recognition.
