Sentenced to LIFE for a non-violent crime

In 2002, I was indicted on a 5 count indictment charges 21.U.S.C,841,856,18 U.S.C.924 (C)&922G, also conspiracy to distribute 50 grams or more of cocaine base. While awaiting trial, I was offered a plea deal of 30 years, at the time, that seemed absurd.  Knowing that the charges were all non-violent, I felt I would get a lesser sentence if I went to trial.

To my dismay, I was found guilty on all 5 counts, and sentenced to LIFE +5 years. It is hard to explain what it feels like to be a young man and receive a sentence of LIFE +5 years imprisonment.

Over the past 19 years, my time has been reduced to 35 years because of new laws being passed. While I am thankful my sentence was reduced, the original sentence remains overly excessive and beyond what was needed to achieve the goal of the sentence.

I am seeking a commutation for ALL offenses I was charged, indicted, and convicted of.  This is where I need you help. Please sign this petition that I will present to clemency.

I can admit, when I was younger, I made irrational and irresponsible choices to engage in criminal conduct. I deeply regret those decisions and I acknowledge that I deserved a very significant punishment. However, I submit that I deserve a second chance to reclaim my life. I am asking the President Biden for a chance to be the Father, Son, Brother, and Law Abiding Citizen I was meant to be. There are no excuses for the selfish decisions I made to engage in criminal activity. My choices separated and hurt my family immensely, not a day goes by that I do not reflect and regret every decision that has led me here.

I am a changed man!

I have a Family that I love and care for deeply.  I am dedicated to never making those mistakes again! I am remorseful for the decisions that I’ve made, not because I am in prison, but rather because they were wrong. I am committed to never again making choices that jeopardize my freedom. Today I realize just how valuable freedom really is. I have a newfound respect for the Law and the consequences that come from bad choices.

Coming to prison was more than a wake up call for me, it was a point in my life when I had to reflect on who I was as a man, as a human, as a citizen, I knew that there was work that I had to do on myself. I realized that all roads in life good or bad begin with one small step. When we choose the path, we also choose the destination. I had to change my character and my way of thinking.

On this path I have completed federally approved rehabilitative programs to better myself.

There are instances where, though a man offends against the letter of the law, yet peculiar circumstance in his case may entitle him to mercy. It is impossible for any general law to foresee and provide for all possible cases that may arise and therefore an inflexible adherence to it, in every instance, might frequent be the cause of very great injustice.

When Judge Siragusa gave me my sentence 2 decades ago, it was evident that it was intentional and unjust. Others, like myself have also experienced this type of discrimination sentencing. I have been a federal prisoner for nearly 20years and I am facing another 12 years for a non-violent drug crime involving crack cocaine, although I was originally sentenced to LIFE +5 years for a non-violent drug offense.

My hope is that President Biden would grant me a 2nd chance to reclaim my life at a time when I can still make a positive impact. My sentence should garner mercy because my continued imprisonment is truly a “cause of great injustice”. There is nothing left to gain in this case. The punishment has been completed. Rehabilitation has been demonstrated by the numerous completed courses. There is nothing left to gain in this case but punishment.

When released on clemency, I have a loving and caring family who are committed with assisting me in a successful reentry to society. I would be relocating to Charlotte, NC where my family currently reside. I plan to work with troubled youth and guide them toward better decisions. My family has a trucking business and a job with my name on it. I just need to be granted this commutation to take advantage of my 2nd chance.
