The Issue
For the consideration of the respected city councilors of Duluth:
I hope this letter finds you in good health and high spirits. I am writing as a concerned resident of Duluth, MN, to respectfully urge you to reconsider the proposed city ordinance that restricts the consumption of marijuana in outdoor public spaces. While I acknowledge the importance of addressing public concerns, I firmly believe that the proposed ordinance may inadvertently impinge upon the personal freedoms of our fellow citizens. Below, I present several compelling arguments in opposition to the ordinance, for your consideration.
Upholding Personal Freedoms: As a society that cherishes individual freedoms and personal choices, it is crucial to safeguard the rights of responsible adults. Restricting the use of marijuana in outdoor spaces infringes upon our citizens' autonomy to make informed decisions about their own bodies and recreational activities.
Mitigating Disproportionate Impact: Studies have shown that such ordinances often disproportionately affect marginalized communities, leading to unintended consequences like over-policing and criminalization of certain demographics. By implementing this ordinance, we may inadvertently perpetuate social inequality and exacerbate existing disparities.
Fostering Responsible Consumption: Instead of imposing bans, we should focus on promoting responsible marijuana consumption and educating the public on the benefits and potential risks associated with its use. Educational initiatives and awareness campaigns can be more effective in maintaining a harmonious community.
Minimal Secondhand Smoke Risks: The concerns regarding secondhand smoke exposure from marijuana are often overstated. Unlike tobacco, marijuana smoke contains significantly lower levels of harmful chemicals and carcinogens. Studies on the health effects of secondhand marijuana smoke remain inconclusive and warrant further research. Therefore, the justification for the ordinance based on secondhand smoke risks is questionable at best.
Effective Regulation: Rather than outright prohibition, we suggest establishing more reasonable regulations, including designated areas for marijuana consumption in outdoor spaces, and/or the omission of public streets and sidewalks from the list of areas that would prohibit consumption. This approach allows for a reasonable balance between individual freedoms and public interests, ensuring that non-smokers are not unduly exposed while permitting responsible consumption for those who wish to partake.

The vast majority of marijuana consumers do not wish to disrupt or impose their choices upon non-smokers; and I believe that the small number of cases that may represent a legitimate public nuisance can be adequately covered as disorderly conduct or disturbing the peace under existing laws that seem to work quite well.
It would be a terrible shame to squander this incredible opportunity to lead by example and show the nation what a respectful, responsible, thriving post-prohibition culture can be - when it's based on the principles of trust, dignity, and good-faith compromise.
