Preserve ISEB (Lowry Masjid's) funds and assets (prevent misuse in litigation)

The Issue

  1. Prevent ISEB's funds including money donated for constructions, operations and other accounts from being used to pay for litigation (lawsuit related costs).
  2. Demand that the current controlling and claimed board should return the fund taken (unauthorized use) from the Phase 3 construction immediately from their personal funds.
  3. The Board provide transparency and update the entire community on the facts of the cases, the current situation, the funds spent and come clean with how they plan and intend to reimburse ISEB for the amount of money spent on litigation thus far.
  4. Demand that the current and claimed board conduct  a General Body meeting with this specific agenda and obtain the approval of the community before they spend even a single dollar towards this litigation.

Relevant facts

  • ISEB's current, claimed and controlling board (refereed to as Plaintiffs) includes Mushtaq Ahmed (Mike), Alam Mustafa,  Ismail Bondre, and Ayub Khan  as well as previous board members including Qadir Mohiuddin and Arshad Shaikh among others.
  • These claimed board members filed the lawsuits (became plaintiff in case numbers RG 16809918, RG 16816682, RG 16816687) currently being adjudicated in the Superior Court of California, Alameda County, Oakland, California.
  • The Plaintiffs (current claimed board) have failed to prove even a single charge against the defendants (former board and current community members including founders of the Islamic center).
  • The Plaintiffs have field fake, made up and defamatory charges against the defendants that include former ISEB board of directors and even founders of the institutions. These are people with very high reputation and good standing in the community.
  • They have spent more than $ 100,000 from the community's funds including $ 35,000 plus of funds donated towards construction of Phase 3 of the project, $ 6000 form construction and the balance from  operations account.
  • The Judge of the Superior Court of California presiding the above mentioned cases has put an injunction preventing the use of these funds for litigation purpose.
  • The Plaintiffs have held secret board meetings to approve paying their attorney on record, Raymond Miller $ 20,000 from operations account.
