The current system is plagued by unacceptable delays, inconsistent service, and a culture that often leaves our heroes feeling abandoned and forgotten.
Despite pledges of support, many disabled veterans still face unfulfilled promises. In these cases, the root cause often lies not in individual failings, but in systemic shortcomings within the VA or military structures. These ingrained issues impact a vast number of veterans and demand urgent attention for comprehensive reform.
Delays, Denials, and Obstacles: Veterans navigating the VA often face a grueling marathon, not a swift sprint. Claims languish in years-long backlogs, appeals get lost in bureaucratic limbo, and essential treatment remains tantalizingly out of reach. As of December 16, 2023, VA’s 378,000+ disability claims currently on appeal are a stark testament to this systemic gridlock. When the veteran finally receives a VA disability rating, these same veterans are consistently forced to wait months for essential appointments, including consultations for critical illnesses and mental health concerns. These delays put their health and well-being at risk and cause immense emotional distress and a sense of hopelessness. It has resulted in unacceptable suicide rates! VA’s own estimates document an average of 6,000 to 6,700 veteran suicides every single year since 2001.
Unbearable Waiting Times and Cancellations without Notice: When the veteran finally receives a VA disability rating, these same veterans are consistently forced to wait months for essential appointments, including consultations for critical illnesses and mental health concerns. Adding insult to injury, veterans often find their appointments canceled without prior notification or re-scheduling, adding further frustration and disruption to their already compromised healthcare journey. These delays and cancellations put their health and well-being at risk and cause immense emotional distress. It has resulted in unacceptable suicide rates!
A Legacy of Denial: For decades, the VA waged a shameful campaign of denial against Vietnam veterans suffering from Agent Orange exposure. Years after the link to cancer and other diseases was established, they clung to technicalities and rigid language, demanding veterans utter the "magic words" to secure their rightful compensation. This pattern of dismissive inertia extends to other issues, like military sexual trauma, where survivors' claims were met with disbelief and stonewalling.
Burdens of Proof and Unwritten Rules: Proving PTSD has been a Herculean task for veterans. The VA's demand for contemporaneous evidence, often absent in the chaos of combat, leaves many clutching at straws. Unwritten rules, like discounting events not documented in military records, add another layer of frustration and unfairness. Our most at-risk veterans are continuously turning to suicide and this must end!
Carelessness and Oversight Failures: The Board of Veterans' Appeals (BVA) returning nearly half of its cases due to the VA's shoddy investigation speaks volumes about systemic negligence. Over 70% of BVA decisions overturned by courts further expose a pattern of errors and oversights. This carelessness translates into tangible harm for veterans, their health, and their well-being.
Unequal Access to Care: The quality and availability of care varies dramatically across VA facilities, creating a system where some veterans receive substandard service while others struggle to access any care at all. This inconsistency is unacceptable and further widens the gap in service our veterans deserve.
Lawless and Arbitrary Practices: The military's disregard for legal obligations towards disabled veterans is appalling. Denying lifetime disability retirement and health care benefits by misinterpreting statutes is not just bureaucratic bungling, it's a violation of trust and a betrayal of service. Similarly, withholding taxes from tax-free lump-sum severance payments for over two decades robbed thousands of veterans of their rightful due.
Systematic Opposition to Veterans' Rights: The VA's historical fight against veterans' right to judicial review and their continued opposition to class action lawsuits paint a disturbing picture. It reveals an institutional resistance to accountability and a preference for keeping veterans locked in a labyrinth of bureaucratic hurdles.
These systemic issues are not isolated incidents, but rather a pervasive pattern of neglect, inefficiency, and even hostility towards veterans. The path to reform requires acknowledging these systemic failures, holding the VA accountable, and prioritizing the well-being of those who served our nation with honor. Only then can we dismantle this labyrinth and ensure veterans receive the support and services they deserve.
To succeed in a malpractice case, the litigant has the obligation to prove the following elements:
Duty: The clinician owed a duty to meet the standard of care to the plaintiff patient.
Negligence: The clinician did not meet the standard of care.
Harm: The plaintiff suffered some type of harm—physical, emotional, and/or financial.
Causation: The plaintiff’s harm was caused by the defendant clinician’s failure to meet the standard of care.
As outlined above, the current Department of Veterans Affairs is a system in crisis and in dire need of immediate reform! This begins by creating a system, for the veterans, that holds VA accountable.
Therefore, We Demand:
1. Federal Legislation Overhaul: Enact comprehensive federal legislation to reform the VA system from the ground up. This legislation should prioritize:
- Immediate reduction in appointment wait-times through staff recruitment, streamlined scheduling processes, and third-party medical care options.
- Mandatory accountability measures for any appointment that represents a 20-day or more delay in scheduling and all appointment cancellations, with automatic notification and re-scheduling procedures implemented.
- Standardized quality of care across all VA facilities, ensuring every veteran receives the same level of service regardless of location.
Increased transparency and oversight within the VA system, empowering veterans to have a voice in their own healthcare journey. - Hold all 155 VA senior leadership staff accountable for each and every part of their individual responsibilities to the position, include their requirements to hold those beneath them accountable.
- Reduce VA’s high turnover of medical professional staff to ensure veterans are not consistently bounced between care providers.
2. Adequate Funding and Resources: Allocate sufficient funding to the VA to ensure it has the resources necessary to implement these reforms and provide quality care for all veterans. This includes funding for:
- Hiring and retaining qualified medical professionals.
- Modernizing VA facilities and technology.
- Expanding mental health services and programs.
- Supporting alternative healthcare options for veterans.
3. Culture Change within the VA: Foster a culture within the VA that prioritizes veterans' needs and values their service and sacrifice. This requires:
- Increased disabled veteran representation in leadership positions within the VA.
- Improved training for VA staff on veteran-specific needs and cultural competency.
- Focus on patient-centered care that respects veterans' choices and autonomy.
Our nation's veterans have bravely defended our freedoms and paid an immense price for our security.
