The issue

We are calling for an urgent investigation into the conduct of Cadi Development Pty Ltd and its director, Sunny Li, following reports from a growing number of NSW homeowners and tradespeople who say they have experienced remarkably similar circumstances.

A significant number of homeowners have now connected with one another on social media. Their stories are disturbingly similar.

  • Contracts are signed.
  • Substantial payments are made.
  • Building works commence.
  • Then projects stall, are abandoned, or homeowners are left scrambling to keep their own homes moving — sometimes being asked to pay tradespeople directly just to continue construction.
  • Some homeowners report losses of hundreds of thousands of dollars, incomplete works and significant defects.
  • Others say they have been forced to take over their own projects or make substantial additional payments simply to get their homes completed.

There are also serious concerns regarding Home Building Compensation Fund (HBCF) insurance, including allegations that insurance coverage was reduced without homeowners' knowledge or consent and that, in some cases, required insurance may not have been obtained at all.

At the same time, tradespeople have come forward reporting substantial unpaid debts, with amounts allegedly ranging from approximately $10,000 to more than $100,000.

This is no longer just a series of individual disputes. We are aware of additional homeowners who may have been affected but have not yet connected with this group. Further cases have also come to our attention through NCAT proceedings involving Cadi Development Pty Ltd.

The question that must now be asked is:

If a builder is repeatedly the subject of complaints, disputes and claims from homeowners and tradespeople, why is that builder continuing to undertake new residential building projects? Homeowners should not have to spend years and tens of thousands of dollars pursuing individual proceedings simply to obtain answers to matters that may warrant regulatory investigation.

There are further matters that demand scrutiny. Concerns have been raised regarding the way resources and funds from clients' contracts are managed across multiple of the builder's own developments. There are also concerns regarding an alleged connection between Sunny Li and a mortgage broker who has been arranging finance and progress-payment claims, including whether information provided to financial institutions accurately reflected the status of his own works. We have become aware that the mortgage broker and Sunny Li have partnered on developments together. We are asking the appropriate authorities to investigate them.

Questions have been raised about the use of different entities and/or insurance arrangements on certain building sites, including connections between Cadi Development, Miao and Co (his mortgage broker, with whom he is working on his own developments), and Lucky Forrest Construction (an identical website, and also listing Sunny's previous foreman as the builder). We are asking the relevant authorities to establish whether any formal or informal relationships exist, and whether those relationships have any implications for licensing, insurance, contracting, financial or other regulatory obligations.

WHERE IS THE REGULATORY OVERSIGHT?

If these allegations are substantiated, this goes far beyond an ordinary contractual dispute.

It raises serious questions about:

  • Whether licensing and regulatory requirements have been complied with;
  • Whether mandatory HBCF insurance has been properly obtained and maintained;
  • Whether homeowners have been adequately protected before and during construction;
  • Whether repeated complaints and proceedings have been appropriately identified and investigated;
  • Whether unpaid tradespeople, incomplete works and abandoned or stalled projects indicate a broader pattern of conduct;
  • Whether financial and progress-payment practices associated with these projects warrant investigation; and
  • Whether other homeowners are currently at risk.
  • We are calling on the NSW Building Commission, NSW Fair Trading, SIRA, icare and all other relevant authorities to conduct a coordinated investigation into these matters and take appropriate regulatory action wherever breaches are established.

WE ARE ASKING FOR ACTION BEFORE MORE PEOPLE ARE HURT.

There are homeowners who say they have lost hundreds of thousands of dollars.

There are tradespeople who say they are owed tens of thousands of dollars.

And there may be other affected people who have not yet come forward.

We are also seeking the attention of NSW media so that these experiences can be independently investigated and brought into the public spotlight.
